The Licensing Sub-Committee granted the application made by Thiyana Limited to vary the premises licence for Subway, located at 76-78 Denmark Hill, London, SE5 8RZ. The variation allows for extended hours for late-night refreshment and the premises' opening hours.

The new hours for late-night refreshment will be from 23:00 to 01:30 from Monday to Wednesday, and from 23:00 to 02:30 from Thursday to Sunday. The premises' opening hours will now be from 08:00 to 01:30 from Monday to Wednesday, and from 08:00 to 02:30 from Thursday to Sunday.

The council's licensing unit objected to the application, stating that the requested hours exceeded those recommended in the Southwark Statement of Licensing Policy (SoLP) for takeaway establishments within the Camberwell District Town Centre Area. The SoLP recommends closing times of 00:00 from Sunday to Thursday and 01:00 on Friday and Saturday for takeaways.

However, the sub-committee noted that the premises had received no complaints or objections from responsible authorities or other persons, apart from the licensing unit's representation based on policy. A local resident, who identified as a bus driver, submitted a representation in support of the application, highlighting the need for a safe and accessible food option for shift workers and essential workers outside of standard hours.

The sub-committee considered that the extended hours would not have an adverse effect on the licensing objectives, particularly given the lack of evidence of public nuisance or crime and disorder connected to the premises. They acknowledged the demand from local residents and businesses for extended service. While the sub-committee did not deem further conditions necessary, they recommended that the premises avoid using single-use plastics. The decision was made in accordance with the Licensing Act 2003, the Section 182 Guidance, and the council's own licensing policy.
