Summary
The Licensing Committee of Wyre Borough Council met on Tuesday, 28 May 2024, to discuss the renewal applications for Wyre dual driver's licences. The committee decided to refuse both applications based on the applicants not meeting the criteria of being 'fit and proper persons' as defined by the council's policies and relevant legislation.
Renewal Application for a Wyre Dual Driver's Licence
The committee reviewed the first renewal application for a Wyre dual driver's licence. The applicant had a recent caution for common assault, an offence of violence. The council's Hackney Carriage and Private Hire Policy states that a licence will not be granted until at least ten years have elapsed since the completion of any sentence. The committee found no exceptional circumstances to depart from this policy and decided to refuse the renewal application.
Councillor Minto and Councillor Baxter sought clarification from the Senior Licensing Officer regarding the treatment of cautions. The representative for the applicant argued that the applicant was of good character and had no previous issues with the police. However, the committee concluded that the incident, which occurred only eight weeks prior, was too recent to consider the applicant a fit and proper person.
Second Renewal Application for a Wyre Dual Driver's Licence
The second renewal application was also reviewed. The applicant had been driving for 24 years and had made significant lifestyle changes following health issues. However, the council's policy requires that drivers meet Group 2 medical standards, which are the same standards required for bus and HGV drivers. The council's Occupational Health Advisor expressed doubt that the applicant met these standards.
Councillor Baxter asked the applicant about the impact of his medication on driving, and Councillor Rushforth inquired about his blackouts. The applicant confirmed that his driving was not affected and that he no longer needed a transplant. Despite commending the applicant for his efforts to improve his health, the committee decided to refuse the renewal application, as they were not persuaded to depart from their policy.
