Summary
The Licensing Committee of Wyre Borough Council met on Tuesday, 28 May 2024, to discuss the renewal applications for Wyre dual driver's licences. The committee decided to refuse both applications based on the applicants not meeting the criteria of being 'fit and proper persons' as defined by the council's policies and relevant legislation.
Renewal Application for a Wyre Dual Driver's Licence
The committee reviewed the renewal application of a driver who had received a recent caution for common assault. The Senior Licensing Officer explained that the applicant's fitness to hold a Wyre Council Dual Driver’s Licence was in question due to this caution. The applicant's representative argued that the applicant was of good character and had no previous issues with the police. However, the committee decided to refuse the renewal application under sections 51(1)(a)(i) & 59(1)(a)(i) of the Local Government (Miscellaneous Provisions) Act 1976. The committee cited the council's policy, which treats cautions as convictions and requires a conviction-free period of at least ten years. The committee found no exceptional circumstances to depart from this policy.
Renewal Application for a Wyre Dual Driver's Licence
The second renewal application reviewed involved a driver with a history of health issues. The applicant's representative highlighted the applicant's long driving history and significant lifestyle changes. However, concerns were raised about the applicant's medical fitness, particularly regarding alcohol dependence and blackouts. The committee referred to the council's policy, which requires drivers to meet Group 2 medical standards. The council's Occupational Health Advisor had expressed doubts about the applicant meeting these standards. Consequently, the committee decided to refuse the renewal application under sections 51(1)(a)(i) & 59(1)(a)(i) of the Local Government (Miscellaneous Provisions) Act 1976, commending the applicant's efforts to improve their health but adhering to the policy requirements.
