The Licensing Sub-Committee of Portsmouth Council met to discuss the application for a shadow premises licence for the Rutland Arms Public House at 205 Francis Avenue, Southsea. The committee decided to grant the shadow licence with conditions, despite concerns from a local resident about noise and disturbances.
Application for Shadow Licence for Rutland Arms Public House
The primary focus of the meeting was the application for a shadow premises licence for the Rutland Arms Public House. A shadow licence acts as an insurance policy for the freeholder, ensuring that the premises can continue to operate under a licence even if the current tenant's licence is revoked or lapses.
Resident's Concerns
A local resident, Mrs. Flood, raised concerns about noise and disturbances from the Rutland Arms. She highlighted issues such as the inadequacy of soundproofing, the frequency of live events, and the late-night use of the garden area. Mrs. Flood stated:
Talking, shouting, and clearing up late at night makes a hell of a racket. We agreed before it would be a lot earlier, and it worked well with that in place.- Mrs. Flood
The resident's concerns were formally recorded and considered by the sub-committee.
Applicant's Response
The applicant, represented by legal counsel, argued that the shadow licence is a separate entity from the current operational licence and does not affect the day-to-day running of the premises. The legal representative explained:
This is not a consideration today of issues that may have been historical or ongoing in relation to the running of the premises under the separate license that's already in existence.- Applicant's Legal Representative
The applicant also agreed to amend the application to reduce the hours for indoor sporting events and the exhibition of films to 23:00 hours on any day.
Decision
The sub-committee decided to grant the shadow licence subject to conditions, including the amendments agreed upon during the hearing. The decision was made after careful consideration of the Licensing Act 2003, statutory guidance, and the council's adopted statement of licensing policy. The sub-committee noted:
The subcommittee cannot ignore the fact that the historical or future perceived issues related to an entirely separate premises license which could be the subject of review or any other action.- Sub-Committee Decision
The decision to grant the licence aims to balance the interests of the business with the concerns of local residents. Formal notification of the decision will be provided in writing to all parties involved.
