The Licensing Act 2003 Sub-Committee was scheduled to convene to discuss a variation of a premises licence. The meeting was also scheduled to cover the procedure to be followed, and to consider whether to exclude the press and public.

Variation of premises licence for The Lacy Nook

The main item on the agenda was listed as being an application to vary the existing premises licence for The Lacy Nook, Wood Street Studios, Barrett Road, Walthamstow, E17 3FU.

According to the report pack, Liber Events Ltd, the applicant, sought to vary the existing premises licence - C08517BARR/1, under section 34 of the Licensing Act 2003.

The proposed variations were:

• To extend the sale of alcohol (on sales) from Wednesday to Sunday 12:00 to 22.00
• To change the opening hours of the premises to:
  • Tuesday 10:00-17:00
  • Wednesday to Saturday 10:00-23:00
  • Sunday 11:00-23:00
• To revise the premises plan associated with the premises.

The report pack notes that two representations were received from responsible authorities, namely the AQEP – noise team, and the planning department, based on the grounds of the prevention of public nuisance.

The Sub Committee was asked to consider the application and decide to either:

(a) grant the application in full; or

(b) grant the application in part; or

(c) refuse the application

The report pack also included general principles for licence conditions, in accordance with paragraph 1.16 of the Revised Guidance issued under section 182 of the Licensing Act 2003, and mandatory conditions applicable to all Premises Licences & Club Premises Certificates. These included conditions relating to the supply of alcohol, exhibition of films, door supervision, age verification policy, permitted price and irresponsible drinks promotions.

Exclusion of press and public

The Committee was also scheduled to consider whether to exclude the press and public from the meeting. According to the agenda, this would be in accordance with Section 100(A) of the Local Government Act as amended, on the grounds that the representations made at the hearing may involve the disclosure of exempt information as defined in paragraphs [1 or 7] of Schedule 12A to the Act as it may include [information relating to any individual or information relating to any action taken or to be taken in connection with the prevention, investigation or prosecution of crime].

Procedure at Licensing Sub-Committee

The agenda included an item to discuss the procedure at the Licensing Sub-Committee. The report pack included a document outlining the procedure for new applications and variations, including the order in which parties would be invited to present their case and answer questions.
