The Licensing Act 2003 Sub-Committee met to consider an application for a premises licence for Tanya Restaurant, located at 624 High Road, Leytonstone, London, E11 3DA. The committee decided to grant the application in part, with amended hours and additional conditions. TheSub-Committee agreed to the amended hours and additional conditions outlined in Appendix F of the agenda.
Tanya Restaurant Licensing Application
The Sub-Committee considered an application by Tatiana Rata, the applicant, for a premises licence for Tanya Restaurant, 624 High Road Leytonstone, London E11 3DA. The application sought to permit the sale of alcohol (on and off the premises), allow the premises to open to the public, and to provide live and recorded music and late-night refreshment. The report before the committee outlined that during the consultation period, the Licensing Service received three representations, one from other persons and two from responsible authorities, namely the police and the Licensing team. The representations were based on concerns regarding the prevention of public nuisance, crime and disorder, public safety, and the protection of children from harm.
During the consultation period, the applicant held discussions with the police, which led to the police withdrawing their representation after conditions were agreed to be added to the licence. Similarly, the Licensing team withdrew their representation after the applicant agreed to include several conditions proposed by the team.
The Sub-Committee decided to grant the application in part, with the following amended hours:
- Hours open to the public: Monday to Thursday - 10:00 to 23:00, Friday and Saturday - 10:00 to 01:00, Sunday - 10:00 to 00:00
- Sale of Alcohol (on the premises): Monday to Thursday - 10:00 to 22:30, Friday and Saturday - 10:00 to 00:30, Sunday - 10:00 to 23:30
- Live and Recorded Music (Inside Premises): Friday and Saturday - 10:00 to 00:30, Sunday - 10:00 to 23:30
- Recorded background music: Permitted at the outside rear area of the premises only until 23:00 Monday to Sunday.
- Late Night Refreshment: Friday and Saturday - 23:00 to 00:30, Sunday - 23:00 to 23:30
- Non-standard timings: On Christmas Eve, Christmas Day, and New Year's Eve, all licensable activities are to be extended until 03:30 into the following day, with the premises closing at 04:00.
The Sub-Committee also added the following additional conditions:
- The number of smokers on the terrace in front of the premises is restricted to a maximum of six, including those seated at the table.
- Alcohol consumed on the premises must be served ancillary to a table meal.
- No alcohol is to be sold for consumption off the premises.
- A telephone number is to be provided to residents for them to contact the supervisor in the event of any concerns emanating from the premises. The phone number is to be displayed at the premises.
- No live music is permitted in the outdoor rear area of the premises; only low-level recorded background music may be played.
In reaching its decision, the Sub-Committee noted that the applicant had presented evidence that the premises is a family restaurant offering a full dining experience, with alcohol served as an accompaniment to meals. The Sub-Committee also acknowledged the applicant's willingness to work with responsible authorities and make changes where necessary to uphold the licensing objectives1.
The Sub-Committee was mindful of the representation made by another person, but was satisfied that granting the application with reduced hours and the agreed conditions would promote the licensing objectives.

The licensing objectives are: the prevention of crime and disorder; public safety; the prevention of public nuisance; and the protection of children from harm. These objectives are set out in the Licensing Act 2003, which governs the sale and supply of alcohol, as well as the provision of regulated entertainment and late-night refreshment. ↩
