Summary

The Hackney Council Licensing Sub-Committee D convened on 4 November 2025, to discuss licensing applications for Pedaller's Corner and Yum Yum Thai Restaurant. A decision was made regarding the application to vary the premises licence for Yum Yum Thai Restaurant, approving the recommendations with specific conditions.

Yum Yum Thai Restaurant Licence Variation

The Licensing Sub-Committee approved the application to vary the premises licence for Yum Yum Thai Restaurant, located at 183-187 Stoke Newington High Street, with specific conditions. The restaurant sought to extend its hours for live music, recorded music, and alcohol sales on the ground floor, Monday through Sunday, and in the basement on Fridays and Saturdays. The application also included non-standard hours for the basement on Valentine’s Day, Christmas Eve, and New Year’s Eve.

The decision was made after considering the licensing objectives, which include the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm, as outlined in the Licensing Act 2003.

The approved recommendations include the following hours for licensable activities:

  • Live Music (Ground Floor): Monday to Sunday, 11:00 - 00:00
  • Live Music (Basement): Friday - Saturday, 18:00 - 02:00, with non-standard hours until 02:00 the following day on Valentine’s Day, Christmas Eve, and New Year’s Eve.
  • Recorded Music (Ground Floor): Monday to Sunday, 11:00 - 00:00
  • Recorded Music (Basement): Friday - Saturday, 18:00 - 02:00, with non-standard hours until 02:00 the following day on Valentine’s Day, Christmas Eve, and New Year’s Eve.
  • Late Night Refreshment (Basement): Friday - Saturday, 23:00 - 02:00, with non-standard hours until 02:00 the following day on Valentine’s Day, Christmas Eve, and New Year’s Eve.
  • Supply of Alcohol (Ground Floor - On-sales): Monday to Sunday, 12:00 - 00:00
  • Supply of Alcohol (Basement - On-sales): Friday - Saturday, 18:00 - 02:00, with non-standard hours until 02:00 the following day on Valentine’s Day, Christmas Eve, and New Year’s Eve.
  • Opening Hours (Ground Floor): Monday to Sunday, 11:00 - 00:00
  • Opening Hours (Basement): Sunday - Thursday, 18:00 - 01:00; Friday - Saturday, 18:00 - 02:00, with non-standard hours until 02:00 the following day on Valentine’s Day, Christmas Eve, and New Year’s Eve.

Additional conditions were added to the premises licence, including:

  • Patrons must use the side entrance on Wilmer Place after midnight to exit the premises.
  • No more than seven patrons are allowed to smoke outside at any time, and no drinks are permitted in the smoking area, which is not to be used after 01:30.
  • The premises licence holder must maintain a dedicated contact telephone number and email address available at all times for complaints, displayed on the premises' website and at the premises.

The Licensing Sub-Committee considered representations from the Licensing Authority, who initially raised concerns about potential public nuisance. These concerns were partially addressed by the added condition that patrons must use the side entrance on Wilmer Place after midnight.

A local resident also made representations, citing noise disturbances and submitting video evidence. The Sub-Committee acknowledged the resident's concerns and the compelling nature of the video evidence.

The Premises Licence Holder stated that they lived in the same building as some local residents, and had carried out noise reduction work within 48 hours of the acoustic report being issued.

The Sub-Committee decided against extending the basement hours to 03:00 on Fridays and Saturdays, reducing them to 02:00, citing concerns about the impact on nearby residents due to the proximity of residential properties. The Sub-Committee noted that the events held in the basement were private and booked in advance, not open to the general public.

The Sub-Committee was concerned about how effective the noise works would be in preventing public nuisance in the future, and felt it was necessary for the works to be tested by the Environmental Protection Service, and to ensure that the sound limiter is operating correctly.

The Sub-Committee advised the Premises Licence Holder to arrange with the Environmental Protection Service to inspect and test the recent sound proofing works, and encouraged them to work with local residents and be proactive with resident engagement to prevent any public nuisance or negative impact in the area.

The Sub-Committee also encouraged the Premises Licence Holder to use sustainable cutlery, plates, cups, food containers, and recyclable disposable materials to avoid using single-use plastic disposable items.

Pedaller's Corner Premises Licence Application

The Licensing Sub-Committee considered an application for a new premises licence for Pedaller's Corner, located at 129-131 Stoke Newington Road. Pedaller's Corner Ltd applied for the licence to allow the sale of alcohol on the premises from Monday to Sunday.

The Environmental Health Authority initially raised concerns regarding the prevention of public nuisance, but withdrew their representation based on agreed conditions. No representations were received from other responsible authorities or other persons.

The Licensing Officer's observations included a recommendation to approve the application with conditions, including that no supply of alcohol may be made when there is no designated premises supervisor1 (DPS) in respect of the premises licence, or at a time when the DPS does not hold a personal licence or their personal licence is suspended.

Other proposed conditions included measures to prevent irresponsible promotions, ensure the availability of free potable water, implement an age verification policy (Challenge 25), and provide specific measures for alcoholic drinks.

Additional conditions consistent with the operating schedule included maintaining a CCTV system, keeping an incident log, training staff on underage sales prevention, and ensuring the consumption of alcohol is by persons seated at tables. The maximum capacity is 50 customers when the café has full use of the space, and 18 customers during regular bike shop hours, including outside seating.

Further conditions addressed noise levels, queue management, supervision of the pavement area, deliveries, waste disposal, and communication with local residents.
