40 The Borough, Downton, Salisbury

The appeal was against the refusal to grant planning permission for the erection of a new dwelling. The planning inspector, H Nicholls, dismissed the appeal.

The main issues identified were the effects of the proposal on:

  • The character and appearance of the site and surroundings.
  • The heritage significance of the Grade II listed building, No 40 The Borough and the Downton Conservation Area.
  • The living conditions of neighbouring occupiers, with particular regard to privacy.
  • The River Avon Special Area of Conservation (SAC).
  • The New Forest Special Protection Area, New Forest Special Area of Conservation and New Forest Ramsar Site (the New Forest Protected Sites).

The inspector found the proposal to be harmful to the character and appearance of the area, and that it would fail to preserve the significance of No 40 The Borough and would fail to preserve or enhance the character or appearance of the CA. The inspector also found that the proposal would conflict with policy 58 of the Core Strategy which seeks to conserve and where appropriate enhance designated heritage assets and their settings in a manner appropriate to their significance.

The inspector also found that the proposal would harm the integrity of the SAC and New Forest Protected Sites.
