The Licensing Authority, Environmental Protection, and a resident have raised objections. The Licensing Authority has made a representation in relation to the application under the Crime and Disorder and Public Nuisance licensing objectives, stating that:

This special policy creates a rebuttable presumption that applications for the grant or variation of premises licences or club premises certificates which are likely to add to the existing cumulative impact will normally be refused following the receipt of representations, unless the applicant can demonstrate in the operation schedule that there will be no negative cumulative impacts with one or more of the licensing objectives.

The Licensing Authority notes that although a number of conditions have been offered, there are no conditions specifically to prevent the premises from adding to the existing antisocial behaviour issues within the area, and that there is no explicit reference in the application to the premises being within the Brick Lane CIA.

Environmental Protection has also objected to the application, stating that there is no noise management plan provided with the application to ensure there will be no impact considering the proposal will be in an already saturated zone.

FT Foods Limited has applied to extend the hours for late night refreshment to 04:00 hours, seven days a week. Currently, the licence permits late night refreshment until 01:00 on Sundays to Thursdays, and until 02:00 on Fridays and Saturdays.

Both the Metropolitan Police and Environmental Protection have lodged objections. The police have raised concerns about the License Holder being able to uphold the Licensing Objectives, and how feasible it will be to enforce them should they increase their operating schedule. Environmental Protection considers the impact of the licensing objectives, particular for Environmental Protection the prevention of public nuisance and the prevention of noise generated from within the premises or outside to be causing disturbance to people in the vicinity.

Application for a Variation of a Premises Licence for German Doner Kebab, 207 Mile End Road, London E1 4AA

The sub committee will consider an application for a variation of a premises licence for German Doner Kebab, located at 207 Mile End Road. Catalin Loan Lonita, the licence holder, seeks to extend the hours for the provision of late night refreshment and to add recorded music as a licensable activity.

Following consultation with the Licensing Authority, Environmental Protection and the Police, the licence holder has agreed to reduce the licensable activities and timings as follows:

  • The provision of regulated entertainment - Recorded music (indoors): Monday to Sunday from 11:00 hours to 23:45 hours
  • The provision of late night refreshment - indoors: Sunday to Thursday from 23:00 hours 00:00 hours; Friday to Saturday from 23:00 hours to 02:00 hours
  • The opening hours of the premises: Sunday to Thursday from 23:00 hours 00:00 hours; Friday to Saturday from 23:00 hours to 02:00 hours

A local resident, Rosalind McGinley, has objected to the application, citing concerns about public nuisance due to noise from customers and delivery couriers. McGinley also notes that a nearby Wetherspoon's pub already causes noise nuisance until 1am, and that the proposed extension would exacerbate this issue.
