Extension of Celtic Sea Power Limited Revolving Credit Facility
The Deputy Leader of the Council and Portfolio Holder for Resources, Adam Paynter, is scheduled to consider a report regarding an extension to the £1.5 million Revolving Credit Facility (RCF) provided by Cornwall Council to Celtic Sea Power Limited (CSP). The current facility is due to end on 30 December 2025, and the report outlines a proposal to extend it until 31 March 2030. This extension is intended to provide CSP with flexibility in managing its cash flow to fund short-term working capital requirements as part of its business plan for 2026-2030. Alongside the extension, an increase in the interest rate from 3.69% to 6.00% is proposed to align with current offerings to Council-owned entities and comply with subsidy control regulations. CSP is an industrial development company focused on the sustainable development of floating offshore wind in Cornwall, aiming to streamline processes and secure inward investment to maximise economic and job opportunities for the region.
Section 75 Agreement for Section 117 Aftercare Arrangements under the Mental Health Act 1983
The Portfolio Holder for Adult Social Care and Health Partnerships, Jim McKenna, is set to consider a report recommending the approval of a Section 75 Agreement with the Cornwall and Isles of Scilly Integrated Care Board (CIOS ICB). This agreement is designed to enhance aftercare services for adults aged 18 and over who are entitled to Section 117 aftercare under the Mental Health Act 1983 (MHA 1983). The proposal aims to establish a unified register and framework for streamlined oversight and coordination across health and social care. A key element is the creation of a pooled budget, with equal 50:50 contributions from both Cornwall Council and the CIOS ICB, to fund community care placements and packages. This pooled fund is intended to remove the need for lengthy negotiations between health and social care practitioners on individual cases, allowing professionals to focus on patient needs and facilitate prompt hospital discharges. The report also recommends the approval of a Section 117 Policy for Cornwall and the appointment of a Pooled Fund Manager. Section 117 of the MHA 1983 places a joint duty on local authorities and NHS bodies to provide free aftercare services for individuals detained under specific sections of the Act, aiming to meet needs arising from their mental disorder and reduce the risk of relapse.
River Camel Mitigation Strategy – Septic Tank Replacement Scheme – Local Development Order
The Portfolio Holder for Tourism, Localism and Planning, Sarah Preece, is scheduled to consider a proposal to proceed with public consultation on a Local Development Order (LDO) for septic tank replacements within the River Camel catchment. This initiative is part of a broader strategy to address restrictions on development in the catchment caused by excess nutrients, particularly phosphates, which have led to an unfavourable status for the River Camel Special Area of Conservation (SAC). The LDO would create a permitting framework for replacing septic tanks with more efficient package treatment plants, thereby reducing phosphate loading. This aims to facilitate new development by providing a mechanism for developers to acquire mitigation credits. The report highlights that the costs of this scheme are eligible for existing grant funding. The LDO would streamline the planning process for homeowners wishing to upgrade their septic tanks, removing the need for individual planning applications and legal agreements for maintenance over the required 80-year period. The proposal is supported by a Habitats Regulations Assessment (HRA) and an Environmental Impact Assessment (EIA) Screening Opinion, which conclude that the LDO can proceed without significant adverse effects on protected habitats or the environment.
Release of Vacant Housing Revenue Account Properties
The Portfolio Holder for Housing, Peter La Broy, is set to consider a report concerning the disposal of several vacant properties within the Housing Revenue Account (HRA). These properties, including 3 Woodland Cottages, 19 Prince Charles Close, 35 Polbrean Avenue, 10 Greenwith Crescent, 23 Moorland Way, 6 Wadebridge Road, 9 and 10 Polvellan Terrace, and Saracen House, have been identified as being in disrepair and untenanted. The housing service has determined that the cost of repairing each property exceeds £50,000, making it economically unviable to retain them as social housing. The report seeks approval to declare these assets surplus to Cornwall Council's requirements and to dispose of them through the Council's Asset Release process, in accordance with Section 32 of the Housing Act 1985 and the Cornwall Council Code of Practice for Land and Property Transactions. The disposal of these properties is expected to generate capital receipts for the HRA, reduce holding costs, and enable third parties to undertake necessary repairs to bring them back into use as occupied homes.
