The Licensing Act 2003 Sub-Committee meeting was scheduled to consider a single application for a premises licence. This application was for Budgens, located at Unit E2, 1 Coronation Square, Leyton, London E10 5UN. The meeting's agenda indicated that representations had been received concerning the application, which would be considered by the committee.
Application for a Premises Licence: Budgens, 1 Coronation Square
The primary item scheduled for discussion was an application for a premises licence for Budgens at 1 Coronation Square, Leyton, London E10 5UN. The application, submitted by Marine Blue Estates Ltd, sought permission for the off-sale of alcohol. The proposed hours for the supply of alcohol and for the premises to be open to the public were initially from 06:00 to 00:00 daily.
During the consultation period for this application, one representation was received from other persons.
This representation raised concerns related to two of the four licensing objectives: the prevention of public nuisance and the prevention of crime and disorder. The report pack indicated that the applicant had engaged in dialogue with the representor, proposing a revision to the alcohol sale hours. The revised proposed hours were from 07:00 to 23:00 on Sundays to Thursdays, and 07:00 to 00:00 on Fridays and Saturdays.
The Sub-Committee was asked to consider the application and decide whether to grant it in full, grant it in part, or refuse it. The report also outlined the general principles for licence conditions, in accordance with paragraph 1.16 of the Revised Guidance issued under section 182 of the Licensing Act 2003. These principles emphasised that conditions must be appropriate for promoting the licensing objectives, precise, enforceable, and tailored to the specific premises. Mandatory conditions applicable to all premises licences, including those related to the supply of alcohol, door supervision, and age verification policies, were also detailed.
The report also included background information on the applicant, Marine Blue Estates Ltd, and the proposed premises, which was described as a brand new Budgens store on a new development. The application was supported by various appendices, including the application form itself, a premises plan, newspaper notices, representations from other persons, correspondence between the applicant and the representor, and a map showing the premises' location.
The report also detailed the procedure at a Licensing Sub-Committee hearing for new applications and variations, which involved the presentation of cases by the licensing officer, applicant, responsible authorities, and other parties, followed by questions and summing-up before the sub-committee retired to make its decision.
