SENIOR OFFICERS EMPLOYMENT AND DISCIPLINARY JOINT COMMITTEE Membership: 6 (3 from Rochford, 3 from Brentwood) Quorum: 3 Chairman and Vice-Chairman: to be appointed by the Joint Committee on an annual basis. Substitutes: Named substitutes (who have been trained) Frequency: As required Purpose
• A Joint Committee with Brentwood Borough Council established in accordance with the provisions of the Local Government Act 1972 to discharge the Council’s functions in relation to the Council’s statutory and senior officers that form part of the two local authorities ‘One Team’ arrangements and make recommendations to Council as required.
The Senior Officers Appointments and Disciplinary Joint Committee shall appoint o An Investigation and Disciplinary sub-committee(s) as appropriate drawn from its members to discharge any of its functions.
o An Appeals Sub-Committee as appropriate drawn from any Members.
• The Senior Appointments and Disciplinary Committee and any sub-committee it appoints shall have regard to the authorities Procedure Rules, the Staff Employment Procedure Rules and all other applicable rules set out under this Constitution and all applicable law.
• The Joint Committee shall comprise 3 representatives from each local authority (Brentwood and Rochford). The Chairman and Vice-Chairman of the Joint Committee shall be appointed by the committee at its first meeting with the two roles being held by a representative from the different councils, and alternated between the councils each municipal year.. Appointment, Dismissal and Disciplinary Action
• a) The function of the appointment, taking disciplinary action against and dismissal of an officer of the Council must be discharged by the Chief Executive (as the Council’s Head of Paid Service) or by their nominated officers.
• b) However, this shall not apply to the appointment, disciplinary action or dismissal in relation to the Statutory Officers detailed in the below table. The appointment or dismissal or disciplinary action in respect of the Statutory Officers are functions of the Senior Officer Appointments and Disciplinary Committee.
