Licensing Enforcement Sub-Committee

LICENSING ENFORCEMENT SUB-COMMITTEE   TERMS OF REFERENCE  

The Terms of Reference of a Licensing Sub-Committee shall include the functions ofthe Licensing and Public Safety Committee with the exception of the consideration ofpolicy issues,which theLicensing andPublic SafetyCommittee hasreserved toitself.   MATTERSRESERVED TO THELICENSING ENFORCEMENTSUB COMMITTEE   1.            Applications for a licence, consent or permit where a representation has beenreceived froma wardcouncillor, amember ofthe publicor anexternal organisation, (excludingthe LicensingAct 2003and GamblingAct 2005).   2.            Applicationsfor alicence, consentor permitwhere theDirector Neighbourhoods & EnvironmentalServices considers that the existing policydoes not provide sufficient clarity on determining the application and/or whereit would be more appropriate for the application to be determined by the Sub-Committee.   3.            Applications for a licence, consent or permit which the law determines cannotbe takenby an officer.  

All matters within the Terms of Reference of a Licensing Sub-Committee which arenot reserved to Full Council, the Licensing and Public Safety Committee or a Sub-Committee asstated above,are delegatedto theDirector Neighbourhoods& Environmental Services.  

N.B.    The City Council’s Constitution Council Procedure Rule Part 4A rule 44(i) (iv) states that decisions which, in the opinion of the Monitoring Officer, are of aquasi- judicialnature, whichincludes thedecisions ofa LicensingSub- Committeemay not bethe subject of an“Objection”.
