Purpose

To recommend to the Portfolio Holder he exercise his delegation to dispose of land at market value to Sutton Bridge Parish Council.

Decision

It is recommended that the Portfolio Holder for Assets and Planning:

  1. Acknowledges that the Strategic & Operational Property Manager, General Fund Assets has effected the process set out by Section 123 (2A) of the Local Government Act, 1972, in respect the land edged red on the plans at Appendix 1 and Appendix 2 as the necessary precursor when considering the disposal of any land that is considered to be ‘open space’ under the Act.
  2. Subject to no material objections being received, determines to dispose of the land edged red on the plans at Appendices 1 and 2 by way of a freehold transfer at their unrestricted market value of £1 each.
  3. Delegates authority to the Strategic & Operational Property Manager, General Fund Assets to secure application of suitable and sufficient Restrictive Covenants within the resulting conveyances together with overage at 80%.

Note – if any objections are received to the Notice issued under s123 (2A) of the Local Government Act then recommendation 2 will not take effect.  In such circumstance any objections will be formally considered before a decision to then dispose could be taken.
