The Executive
resolved to:
(i)
Approve the implementation of the discretionary review in
accordance with an amended Appendix 3 to remove references to
householders to ensure that it considers any errors which may have
been made by the council in relation to residential
applications.
(ii)
Note the wider programme of improvements the Council will be making
to how it administers CIL as set out at paragraph 5.6 of the
report.
(iii)
Approve a supplementary estimate of £75,000 from the Medium
Term Financial Plan Risk Reserve to secure additional independent
resource to carry out a full review of each case that comes
forward.
(iv)
That a report is considered by the Executive at the first available
meeting following 3 months from the start of the Review and
similarly at 9 months and following the end of the 12 month review
period. The report will confirm the number of cases that have been
reviewed over the period, summary of decisions made and lessons
learnt during the Review together with a summary of changes made to
the customer journey.
(v)
It is further recommended that the Executive request that Community
Infrastructure Levy (CIL) Review and Reform Temporary Executive
Working Group prioritise a Review of the Enforcement Policy.
