Purpose: To approve expenditure on CIL Bids under the CIL Expenditure Programme – June 2025
Content: It was RESOLVED: - 1.1 That the CIL Expenditure Programme (June 2025) and accompanying Technical assessments of the following three CIL Bids (forming Appendices A and B) be approved (including decisions on these CIL Bids for Cabinet to make/note) as follows: - Decision for Cabinet to make: - Ringfenced Infrastructure Funds (Elmswell and Woolpit) and Strategic Infrastructure Fund CIL Bid, Location and Infrastructure Proposed Amount of CIL Bid and total cost of the infrastructure Cabinet Decision M24-26 WOOLPIT and ELMSWELL Footway and Cycleway Amount of CIL Bid £3,099,930.16 Total cost of the project £3,498,425.00 (excluding VAT) Other sources of funding S106 – £398,494.84 Subject to:- 1. National Highways providing final approval/agreement to the design of the section of the route that makes use of the A14 overbridge. 2. A further section around the new Woolpit roundabout and leading into Woolpit village will be provided by Highways using an additional £300K of Local Transport Plan monies 3. Dedication of land that is part of the route but not currently owned by Highways and which would need to be designated as part of the public highway 4. An appropriate mechanism between Mid Suffolk District Council and Suffolk County Council being agreed and secured to enable a) the forward funding of this project using District CIL funding with b) relevant commitments from SCC to secure timely recovery of this forward funding through, but not limited to s106 contributions, in relation to future growth proposals in both villages with reimbursement of these District CIL funds against any new future growth in both villages via s106 agreements. The latter has been agreed in principle with SCC and would need to be reinforced by securing an appropriate mechanism between both Councils. 5. A programme being devised and implemented of regular meetings (suggest monthly) by SCC with all stakeholders of this project) so as to keep everyone updated on design, costs and delivery timescales. the recommendation to Cabinet is to approve this CIL Bid for £3,099,930.16 from the Ringfenced Infrastructure Funds – (Elmswell and Woolpit and Strategic Infrastructure Fund). Decisions for Cabinet to make: - Ringfenced Infrastructure Funds (Rattlesden and Needham Market) M24-28 RATTLESDEN Rattlesden Church Warmth project (installation of lighting and heating chandeliers) Amount of CIL Bid £33,750.00 Total cost of the project £45,000.00 (excluding VAT) Other sources of funding Church Reserves contribution £11,250.00 Recommendation to Cabinet to approve CIL Bid M24-28 for £33,750.00 from the Ringfenced Infrastructure Fund (Rattlesden) M24-29 NEEDHAM MARKET Needham Market Football Club Upgrade (New Stand and Improvements) Amount of CIL Bid £100,000 Total costs of the project £344,139.50 (excluding VAT) Total of eligible project costs for this CIL bid £210,494.50 Other sources of funding for CIL bid Premier League Stadium Fund £110,494.50 Other sources of funding for the total project Premier League Stadium Fund £59,434.00 MSDC Capital Grant £10,000 Needham Market Football Club Funds £50,000 Directors £14,211.00 Recommendation to Cabinet to approve CIL Bid M24-29 for £100,000 from the Ringfenced Infrastructure Fund (Needham Market) 1.2 Cabinet were also asked to note and endorse this CIL Expenditure Programme which includes details of emerging infrastructure/CIL Bids (Appendix A Section C). REASON FOR DECISION Community Infrastructure Levy (CIL) monies have been collected since the implementation of CIL on the 11th April 2016. The CIL Expenditure Framework was originally adopted in April 2018 and reviewed with amendments adopted by both Councils in March 2019, April 2020, March 2021, July 2022 (Mid Suffolk),October 2022 (Babergh) and in March 2023 and March 2024. The CIL Expenditure Framework requires the production of a CIL Expenditure Programme for each District and contains decisions for Cabinet to make or note on CIL Bids for CIL expenditure. These decisions relating to the expenditure of CIL monies form one of the ways in which necessary infrastructure supporting growth is delivered. Alternative Options Considered and Rejected: There is a diverse spectrum of approaches to CIL expenditure across the country from Unitary Authorities who have absorbed CIL into their individual Capital Programmes to others who ringfence all funds to be spent locally. A range of different approaches was identified in Appendix A of the Framework for CIL Expenditure report provided to Cabinet’s on the 5th and 8th of February 2018 and discussed in full during the workshops with the Joint Member advisory panel. Members adopted the original Framework documents set out in paragraph 1.1 above by Council decision in April 2018. These were subsequently reviewed and adopted by both Councils on:- · First Review - March 2019 · Second Review – April 2020 · Third Review – March 2021 · Fourth Review – 21st July 2022 (Mid Suffolk) and 6th October 2022 (Babergh) · Fifth Review - March 2023 · Sixth Review – March 2024 · Seventh Review – has taken place in March/April 2025 with outcomes likely to be considered at full Council in June 2025 Any Declarations of Interests Declared: Councillor Mellen declared an interest as the Suffolk County Councillor for Elmswell and Woolpit Any Dispensation Granted: None
