Purpose:
Content: Decision: That the Committee authorises the Joint Assistant Director (Assets &Property): (1) to expend £1,550 to undertake a rental valuation of the storage shed and small area of land at Sutherland Memorial Park on behalf of the Trustees, and (2) to subsequently enter into negotiations and to agree lease terms for two lettings to local sports clubs on the basis that the rental terms agreed accord with the market rent value. Reasons: · To obtain an independent rental valuation of charitable land to ensure a full market rent is achieved by the Council as sole Trustee, as required by the Charity Commission, when dealing with all charitable property transactions. · To agree terms for the grant of two new leases to three local sports clubs. Other options considered and rejected by the Committee: · To not consent to the valuation of the charitable land for rental purposes and the subsequent risk of challenge that the Council as sole Trustee of the charity, has not complied with its charitable obligations. · Not to lease the property.
