Content: RESOLVED:   Application for a Premises Licence – The Mildmay Club and Institute, 33 - 34 Newington Green, London N16  - APPROVAL   The decision of 22nd October 2025   The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:   ·  The prevention of crime and disorder ·  Public safety ·  Prevention of public nuisance ·  The protection of children from harm   The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.   ·  The hours of licensable activity have been approved as set out on the report.      ·  Remove condition 16 on the report duplicate condition.     And the following amended and additional conditions will be added to the premises licence:     ·  A noise limiter will be installed in the main hall on the first floor and be set at a level that prevents a noise nuisance at the boundary of any neighbouring residential premises.      ·  Regulated entertainment throughout the premises will be played at a level so as to not cause a noise nuisance at the boundary of any neighbouring residential premises.   ·  All external doors and windows shall remain closed whilst regulated entertainment is taking place, save for access and egress.     ·  The Coachway off the Members Bar will be utilised as the designated smoking area for members and their bona fide guests. This area will be restricted to 15 smokers at any one time.     ·  When regulated entertainment is taking place in the Main Hall and/or the Small Hall, 20 smokers will be directed to smoke outside the front of the building within the footprint of the premises.     ·  On a Friday and Saturday after 20:00, all smokers at the front of the building will be monitored by the on-duty SIA door supervisor. This area will be restricted to 20 smokers at any one time.   ·  The SIA shall remain at the premises until patrons have dispersed.     ·  Smokers will not be permitted to take drinks outside with them at any time.     ·  Glass bottles will not be emptied into outside bins between the hours of 22:00 and 08:00 the following morning.     ·  Patrons are not permitted to use the fire escape other than in an emergency.     ·  The Premises Licence Holder shall maintain a dedicated telephone number and email address that must be available at all times. These contact details shall be included on any website of the premises and on display at the premises.   Reasons for the decision   The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined.      The Sub-Committee took into consideration that there were 19 representations from Other Persons (local residents), 9 objections to the application and 10 representations in support of the application. The Sub-Committee noted the Environmental Enforcement Service withdrew their representations before the hearing after agreeing conditions with the Applicant. The Sub-Committee took into account that the Licensing Authority made representations on the grounds of the prevention of Public Nuisance. The Sub-Committee noted that no other Responsible Authorities made representations.     The Sub-Committee took into consideration the Applicant’s legal representative’s representations that there will be little difference in the operation of the premises that will remain a members club.     The Sub-Committee heard the Applicant’s representations that the Environmental Protection Service visited the premises and had no issues with the noise at the premises. The Sub-Committee noted that on Wednesday and Thursday night there is a door entry system which ensures safety for customers entering the premises. In addition they have a security guard on Fridays and Saturdays.     The Sub-Committee took into account the Applicant’s legal representative made representations that there were no other complaints about other parts of the premises as the music was played through a noise limiter. The Applicant’s legal representative made representations that the noise was tested at 85 dB and there was no noise found outside of the premises and the windows and doors were closed.     The Sub-Committee noted that since the recalibration of the noise limiter in August 2025 no new noise complaints were received.     The Sub-Committee noted the Licensing Authority maintained their objections, however, they were satisfied that the concerns were addressed by the Applicant. The Sub-Committee felt that the conditions helped to mitigate the concerns and overcome the objections. The Sub-Committee took into consideration the comprehensive dispersal policy provided by the Applicant and they were satisfied that the Applicant had demonstrated that they had the necessary processes and procedures in place to operate the premises responsibly and to prevent any public nuisance. The Sub-Committee noted that the Applicant demonstrated that they were prepared to work with the local residents and to resolve any concerns.     The Sub-Committee took into account that the Applicant had invited the Environmental Protection Service to inspect the soundproofing works and the noise limiter. However the Sub-Committee noted that the Environmental Protection Service had failed to make any representations.     The Sub-Committee took into consideration that the application was supported by the Clissold Ward Councillor.     Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would not be undermined.   Public Informative     1.  The Premises Licence Holder agreed to surrender the club premises certificate upon the grant of the new premises licence. It was noted that the premises would still be operating as a members club.     2.  The Premises Licence Holder is advised to consider installing double glazing to prevent noise breakout.     3.  The Premises Licence Holder is advised to inform anyone that is likely to be affected when they are holding events.     4.  The Premises Licence Holder is encouraged to engage in meaningful dialogue with the local residents to resolve any impacts of noise  emanating from the premises.     5.  The Premises Licence Holder is strongly encouraged to use sustainable   cutlery, plates, cups, food containers, and recyclable disposable materials to avoid using single-use plastic disposable items.
