Purpose:

Content: Erection of 159 dwellings with associated landscaping, access and parking following phased demolition of existing buildings (Amended Scheme 2).   Decision   Planning Permission REFUSED for the following Reasons   1.      Overbearing/increased sense of enclosure  The proposed development would by reason of the scale and relationship of the development to the existing neighbouring dwellings be overbearing and result in an increased sense of enclosure harmful to the residential amenities of existing neighbouring occupiers contrary to Policies DM1 and DM5 of the Waverley Local Plan (Part 2) 2023, Policy FNP1 of the Farnham Neighbourhood Plan (2020) and the NPPF.   2.    Lack of S106 contributions In the absence of a Section 106 Agreement to secure the provision of a healthcare contribution, highway infrastructure, mitigation and contributions and suitable management arrangements for the property and public realm, the proposal fails to mitigate the impacts of the development and ensure that the development is provided with the necessary infrastructure to create a sustainable community, contrary to the requirements of Policies  ICS1 and ST1 of the Local Plan (Part 1) 2018, Policy FNP32 of the Farnham Neighbourhood Plan (2020) and the NPPF .   3.    SPA In the absence of an appropriate legal agreement, the proposal would have a significant effect on the integrity of the Thames Basin Heath Special Protection Area (SPA). Accordingly, since the planning authority is not satisfied that Regulation 64 of the Conservation of Habitats and Species Regulations 2017 (as amended) (The Habitats Regulations) applies in this case, it must refuse permission in accordance with Regulation 63 of the Habitats Regulations and Article 6(3) of Directive 92/43/EE. The proposal conflicts with Policies NE1 and NE3 of the Local Plan (Part 1) 2018, Policy FNP12 of the Farnham Neighbourhood Plan (2020) and the NPPF.
