Content: Resolved- As a preliminary issue, the Panel considered the Licence Holder’s application for a further adjournment. The Panel took into account the reasons for the request offered by the Licence Holder and heard from representatives of the Police and West Yorkshire Trading Standards on this point. Having done so, the Panel decided that it was in the public interest and in the interests of justice that the hearing should proceed. The Panel had written submissions and explanations from the Licence Holder and was therefore able to consider these when it heard the substantive review application. The hearing of the review then proceeded. At the end of the hearing, the Panel took time to deliberate and resolved unanimously as follows: Having carefully considered the application for review; all valid representations made by the parties to the hearing; valid written representations received during the statutory period; the published statement of licensing policy; and relevant statutory guidance, the Panel considered that the Licence Holder had failed to uphold the licensing objectives, based on the evidence heard. Therefore, the Panel determined that the premises licence be revoked in respect of Fresh Market, 263 Allerton Road, Bradford, BD15 7QU. Reason: It is considered that the revocation is necessary, appropriate, and proportionate to ensure compliance and the promotion of the licensing objectives.
