Purpose: To seek approval from this Committee to proceed with a marketing exercise to seek leasehold offers the café.

Content:   12.1 The Committee considered a report of the Executive Director of Neighbourhood Services which sought approval to offer the café at Firth Park to the market on a leasehold basis.     12.2 RESOLVED UNANIMOUSLY: That the Charity Trustees Sub- Committee authorises the Head of Property Services to offer the café to the market on a leasehold basis. and to report back to Committee following this exercise to decide whether any offers received are in the best interest of the Firth park Charity.         12.3 Reasons for Decision     12.3.1 The proposal to offer the café to the market will enable other operators to express interest and bid for the lease. This should assist in achieving a market rental value for the property although other criteria would be set under which a decision on leasing would be assessed, based on looking to ensure that such decision was is the best interests of the Charity.         12.4 Alternatives Considered and Rejected     12.4.1 Alternative Option 1: Do nothing Reasons for Rejection: The current Tenancy agreement is effectively a short-term arrangement originally predicated on the operator’s future plans to retire. It would not be appropriate to let this Tenancy run on beyond the short term. A formal lease arrangement would be more appropriate and in the best interests of the charity.     12.4.2 Alternative Option 2: Grant a lease to the current operator Reasons for Rejection: The cafe has not been offered to the market for over 15 years, and it is in the interests of the charity to assess whether other operators may benefit the charity more than the current arrangement.
