Purpose:

Content: The Sub-Committee carefully considered all the evidence before it, including the Applicant’s representatives submissions, the representations from the Responsible Authorities, Wolverton and Greenleys Town Council and the local resident. It noted the application had stated that, in order to meet the Licensing Objective ‘The Prevention of Public Nuisance’, the applicant had offered an investment in soundproofing measures which would include double glazing to the front of the premises only and the Applicant’s representative confirmed they would welcome any advice from the Responsible Authorities with regard to noise monitoring. There had been concern with regard to the authenticity of the specialist deep cleaning certificate, as The Phoenix Group had dissolved in 2020 and the expiry date had been misspelt. The premises seated 24 patrons, but the Applicant’s representative could not confirm how staff would monitor and control the number of customers to prevent overcrowding during peak hours. In response to the representation from the Bucks Fire and Rescue, the Applicant’s representative had submitted a fire risk assessment which had been undertaken by MK Telecommunications and Solutions Ltd.  However, during the hearing, they admitted this had been an error and SK and Electrical Gas Services had carried out the assessment.  In response to the representation from Environmental Health, it had been noted that the applicant had repaired the fan located on the rear wall of the kitchen by mounting a plastic bucket which had been screwed to the wall. It was noted that the Applicant had negotiated the hours applied for and had offered collection / deliveries until 03.00 hours, Monday to Sunday, and a SIA door supervisor be employed. The Sub-Committee had concerns regarding the outstanding issues on fire safety and noise pollution from the premises. The Sub-Committee resolved: 1.         That the application be refused. 2.         That the following additional condition be added to the current licence:             ‘That all deliveries be made to a residential property after 23:00 hours’. 3.         That the large funnel chimney be cleaned by an accredited company and a certificate be provided to Environmental Health prior to a visit in eight weeks from service of this Decision Notice. 4.         That the Bucks Fire and Rescue officer inspect the premises to ensure it is fire safety compliant as soon as is practicable.
