Purpose:
Content: The Sub-Committee carefully considered all the evidence before it, including the Premises Licence Holder’s representative’s submission and the representations from the Responsible Authorities. It noted that the Closure Order had not been appealed and the deadline of 21 days had lapsed. However, the Premises Licence Holder’s representative confirmed they would be approaching the Magistrates Court to seek permission to lodge an appeal. It noted that the Premises Licence Holder undertook training for all staff members and had not known that training records had to be presented upon request. The representations from the Responsible Authorities primarily related to the Licensing Objective ‘Protecting Children from Harm’ had not been promoted, together with the lack of confidence in the management of the premises. It was also noted that a number of illegal vapes had been seized on separate occasions from the property. The Sub-Committee’s primary objective had been to support and reinforce the promotion of the Licensing Objectives, in particular the ‘Prevention of Crime and Disorder’ and ‘Protecting Children from Harm’. The Sub-Committee resolved: 1. That the premises licence be suspended for three months. 2. If the Premises Licence Holder is able to demonstrate full compliance with the conditions on the premises licence, the suspension be lifted earlier with the agreement of a Licensing Officer.
