Purpose:
Content: The Sub-Committee carefully considered all the evidence before it, including the Premises Licence Holder’s representative’s submission and the representations from the Responsible Authorities. It noted that there had not been a designated smoking shelter in the garden and customers would go onto the High Street to smoke, or stand outside the back door where a door supervisor would be present. There had been adequate signage reminding customers to be respectful to residents when leaving the premises. The focus had been the effect that the licensable activities had been having to residents living in and around the area, together the operational needs of the business and the general duty to promote the Licensing Objectives. The Sub-Committee resolved: 1. That all licensable activities cease as follows: Monday to Thursday 23:30 hours with the premises closing at 00:00 hours. Friday and Saturday Live Music at 23:30 hours and the supply of alcohol at 00:00 hours with the premises closing at 00:30 hours. Sunday Live and Recorded Music and the supply of alcohol at 22:30 hours with the premises closing at 23:00 hours. 2. That the following conditions be added to the current licence: 1. A complaints log will be maintained and all complaints from residents will be recorded therein. Any complaint logged will include date, time, name of complainant (if known) and reason for complaint. Any action taken in relation to that complaint to also be recorded. A copy of the log will be made available to officers of the Licensing Authority on request. 2. A Garden Management Policy will be drawn up and implemented at the premises within 21 days upon receiving the written Decision Notice. Staff required to implement the plan will be trained accordingly. A copy of the plan will be made available to officers of the Licensing Authority on request. 3. A Dispersal Policy will be drawn up and implemented, within 21 days upon receiving the written Decision Notice, to ensure customers leave the area quickly and quietly. A copy will be made available to officers of the Licensing Authority on request. 4. No more than six external events where any entertainment is to be provided will be held in any calendar year. Any entertainment provided as part of these events will finish by 19.30 hours. A minimum of four weeks between each external special event. 5. A minimum of four weeks’ notice will be given to the Licensing Authority of upcoming external special events with regulated entertainment, unless an event is postponed due to weather or other circumstances, in which case notification of the postponement and the revised date will be given within 24 hours of said postponement. 6. External events with regulated entertainment will be advertised on the pub’s social media, and emails sent to any resident who provides details for this purpose, of upcoming external events a minimum of three weeks prior to the events as set out above. If an event is postponed due to weather or other circumstances, notification of the postponement and the revised date will be given within 24 hours of said postponement. Notification to residents will include the following: (a) date and times for the event; (b) type of entertainment and times it will be provided (including any gaps between entertainment); and (c) a dedicated number to call in the event of complaints. 7. Doors and windows are to be closed except for access and egress during entertainment inside the premises. 8. That the back gate be locked at 22:00 hours to prevent customers ingress and egress and only be used by staff after this time. 9. That acoustic foam be installed around the stage, ceiling and windows. 10. That management and supervisory staff provide a contact number for residents, upon request. 11. That a type of noise limiter be installed and operated at all times and the location and setting to be agreed with the Licensing Authority and Environmental Health in writing, and that agreement must also state the noise trigger level at which the noise limiter will activate, and a written log be maintained of how many times the device has been activated and be made available on request from the Licensing Authority over a rolling twelve month period. 12. The Licensing Act 2003, Section 177A exemption pertaining to live and recorded music does not apply in relation to this premises licence (S.177A(3)). For the avoidance of doubt, the provision of regulated entertainment in the form of live and recorded music is restricted to the hours set out in the premises licence and all conditions relating to live and recorded music are to apply at all times either activity is undertaken at the premises. 3. That the following conditions be amended on the current licence: 1. That internal special events (twelve occasions per year) cease at 01:00 hours. Notification must be given to the Licensing Authority in advance and a record of these events kept at the premises. 2. Condition 2.11 to add - ‘or any other form of ID as approved by the Home Office for age verification of alcohol sales’ to the list of acceptable ID. 3. Condition 2.25 be amended to refer to ‘Public Nuisance’.
