Summary

Open Council Network is an independent organisation. We report on Southwark and are not the council. About us

The Licensing Sub-Committee of Southwark Council met on Monday 11 January 2010 and granted licences to two premises, Dulwich College Preparatory School and Sierra Spot, with conditions attached to both.

Dulwich College Preparatory School

The sub-committee granted the application for a licence for Dulwich College Preparatory School, located at 38-44 Allyn Park SE21 7AA, with minor amendments. The decision was made after considering written and oral representations from the applicant and local residents who had objected to the application.

Conditions imposed on the licence include:

  • No music to be played outside the premises after 9:00 PM on any night.
  • No third party to be permitted to play music outside.
  • No third party to serve alcohol at any time.

The sub-committee stated that these limitations on the sale of alcohol were necessary for the protection of children from harm. The licensee and any person who made relevant representations have the right to appeal the decision to the magistrate's court within 21 days of being notified of the decision.

Sierra Spot

The application for a licence for Sierra Spot, located at 6 Arnside Street, London SE17 2AP, was also granted with minor amendments. This decision followed the presentation of the applicant's case, questioning from sub-committee members, and representations from the ward councillor, Councillor Paul Bates, who objected on behalf of local residents.

The conditions attached to the Sierra Spot licence are extensive and include:

  • A security search of the premises must be conducted before opening to the public, with a record kept of who performed the search.
  • Drugs Free Zone and No Search No Entry, Management reserve the right to refuse entry signs must be displayed in the entrance foyer.
  • All matters relating to drugs must comply with the Metropolitan Police Best Practice Guide on the handling of drugs in pubs and clubs.
  • Suitable notices and announcements must be displayed and made, requesting patrons to leave the premises quietly and in an orderly manner to avoid disturbing local residents.
  • A CCTV system must be installed, maintained in good working order, and continually recording whenever the premises are in use under the licence. The system must be capable of capturing an image of every person entering the premises.
  • All CCTV footage must be kept for 31 days and made available to Police and Council Officers upon request.
  • Any regular and external promoters hiring the premises must complete the 'Venue Hire Agreement' provided by Southwark Council, and a copy must be provided to the Police and Licensing Unit at least 14 days prior to the hire date.
  • A Personal Licence holder must be on the premises and on duty at all times that intoxicating liquor is supplied.
  • There will be no loading or removal of equipment from the premises between terminal hours and 8:00 AM the following day.
  • The use of the smoking area shall be limited to a maximum of 6 patrons, and smokers will be prohibited from taking drinks outside.
  • Recorded music will be limited to background noise levels only throughout the opening hours.

The sub-committee stated that these conditions were necessary to prevent public nuisance, given the premises' location in a residential area. Similar to the Dulwich College Preparatory School decision, the licensee and any relevant objectors have the right to appeal to the magistrate's court within 21 days.
