Summary
A meeting of South Oxfordshire District Council's Licensing Panel was held to discuss amending the wording of a decision notice relating to the premises licence of Ale Van, Bar & Events Limited, 34 Hart Street, Henley-on-Thames. The meeting was called because the decision notice issued following a Licensing Panel hearing on 16 June 2021 did not accurately reflect the Panel's decision on that date.
Amendment to decision notice for Ale Van, Bar & Events Limited, 34 Hart Street, Henley-on-Thames.
A report was presented to the Licensing Panel that detailed a clerical error in the decision notice issued following their meeting on 16 June 2021. The Panel was asked to consider amending the wording of the decision notice.
The report explained that:
It has recently been necessary to speak to the premises licence holder about a possible breach of the Annex 2 conditions on the licence. Their solicitor referred to the decision notice and pointed out that the wording of the decision notice made no mention of the Annex 2 conditions and therefore those conditions are invalid.
The report goes on to say that this was an administrative error, and that:
It is suggested that the correct wording should have included that the licence is granted subject to “such conditions as are consistent with the operating schedule accompanying the application” which would be added after reference to the mandatory conditions at the bottom of page one, in addition to the Annex 3 conditions imposed by the panel within the decision notice.
