The Licensing Sub-Committee will be provided with a report on an application for a new premises licence for a Popeyes restaurant at 67-68 The Broadway in Ealing Broadway. The meeting will also consider whether to exclude the public and press from part of the meeting.
Application for a New Premises Licence for Popeyes, 67 - 68 The Broadway. Ealing, W5 5JN/ Ealing Broadway
The Licensing Sub-Committee will be asked to consider an application for a new premises licence for Popeyes, a fried chicken restaurant, at 67-68 The Broadway. The applicant, PLK Chicken UK Ltd, has applied for a licence to serve late night refreshment from the premises from 11pm until midnight Sunday to Wednesday, and 11pm until 1am Thursday to Saturday.
Ealing Civic Society has objected to the application on the grounds that it would be likely to increase public nuisance. They point out that the premises is in the Ealing Broadway town centre Cumulative Impact Zone1, and argue that the application is unacceptable because the requested hours exceed the core hours for late night refreshment in the zone. They also note that there is a condition on the planning permission for the premises that only permits trading between the hours of 10.30am and 10.30pm, and suggest that the applicant should withdraw their application and abide by the shorter hours. The report to the Licensing Sub-Committee notes that the applicant has proposed conditions designed to promote the licensing objectives, including the employment of door supervisors and the installation of CCTV, and to minimise any cumulative impact, including closing to the public from midnight Sunday to Wednesday and 1am Thursday to Saturday and operating a delivery-only service for an hour after closing.
Popeyes operates successfully in other Cumulative Impact Zones by ensuring that their operations do not impact the main concerns associated with restaurants and takeaways such as; Noise from patrons or delivery vehicles Litter dropped by patrons. Cooking smells. People congregating after late-night drinking, where there is a small associated risk for violence and anti-social behaviour to occur as a result. Much of the late night cumulative impact concerns are caused by alcohol led premises. Even though Popeyes do not serve or sell alcohol, Popeyes recognise that after 1am there is a chance that persons could be attracted to the restaurant from alcohol premises. Popeyes therefore propose to close to the public at Midnight Sunday to Wednesday and 01:00 Thursday to Saturday and to request delivery only on those days for one additional hour whilst the premises are closed to the public. In our respectful submission, any cumulative impact would be negated as a result.
The Sub-Committee will be asked to decide whether to grant the application in full, to grant the application with modified conditions, or to reject the application.
Matters to be Considered in Private
The Sub-Committee will be asked to determine whether to consider any matters in private. Section 12A of the Local Government Act 1972 allows councils to consider matters in private if they contain information that is exempt from disclosure, such as confidential information about individuals.
The agenda does not specify which, if any, matters the Sub-Committee will be asked to consider in private.
