Summary
The Licensing Panel will be considering an appeal against the decision of the Licensing Sub-Committee to refuse the grant of a premises licence for The Wheelhouse, Royal Victoria Country Park. The meeting will also involve a discussion of Fareham Borough Council’s Statement of Gambling Policy.
Appeal Against Refusal to Grant a Premises Licence for The Wheelhouse, Royal Victoria Country Park
The Licensing Panel will be considering an appeal against the decision of the Licensing Sub-Committee to refuse the grant of a premises licence for The Wheelhouse, Royal Victoria Country Park.
The appeal has been made by One Stop Catering Limited against a decision taken at a meeting of the Licensing Sub-Committee on 17 September 2024. The Sub-Committee refused to grant a premises licence for The Wheelhouse because they were not satisfied that the licensing objectives would be promoted.
The Sub-Committee acknowledged that the applicant had addressed the concerns of residents in relation to potential public nuisance and that there was no evidence to suggest that there would be an increase in crime and disorder. However, the Sub-Committee were concerned that the applicant could not demonstrate how the licensing objective of the protection of children from harm would be promoted.
The appeal will be considered at a hearing of the Licensing Panel, where the appellant and interested parties will be able to make representations. The Licensing Panel will then decide whether to uphold the appeal or not.
Statement of Gambling Policy
The Licensing Panel will be asked to recommend a revised Statement of Gambling Policy to full Council. The Council has a statutory duty to prepare a Statement of Gambling Policy, which must be reviewed every three years.
The Statement of Gambling Policy sets out the Council's approach to the regulation of gambling in the borough, and includes details of:
- the licensing objectives
- how the Council will promote the licensing objectives
- the process for applying for a gambling licence
- the Council's enforcement policy
- arrangements for consulting with interested parties
The Council undertook a public consultation on the draft Statement of Gambling Policy between 2 September and 21 October 2024.
