The Lambeth Council Licensing Sub-Committee met to review the premises licence for Aquum at 68-70 Clapham High Street, following an application by the Metropolitan Police after a serious sexual assault was alleged to have occurred at the venue. The committee decided to make permanent the interim steps that had been put in place, with some amendments to the conditions. These steps included the removal of the designated premises supervisor (DPS) and the imposition of new conditions on the licence.
Aquum Licensing Review
The sub-committee reviewed the premises licence for Aquum following an application by the Metropolitan Police. The application was triggered by an allegation of serious sexual assault at the premises on 29 March 2025.
The police had applied for a summary review under Section 53A of the Licensing Act 2003, contending that the premises was associated with serious crime and disorder.
The committee reviewed the interim steps that had been put in place on 10 April 2025, which included the removal of the DPS and the modification of the premises licence conditions.
One representation was received from a member of the public supporting the review, raising concerns about increased crime, noise, and anti-social behaviour associated with licensed premises in the area. The resident suggested that the licence should be permanently suspended.
Decision
The sub-committee determined that the interim steps should be made permanent, finding that this was both appropriate and proportionate. The interim steps that were reimposed as permanent conditions were:
- All door supervisors must be employed by a firm on the Security Industry Authority’s (SIA) accredited Approved Contractors Scheme[^1]. [^1]: The Security Industry Authority (SIA) is the organisation responsible for regulating the private security industry in the United Kingdom. The Approved Contractor Scheme (ACS) is a voluntary scheme that assesses security companies against a range of criteria, including their business practices, training, and security standards.
- Terry Giorgio, his son Harry Georgiou, and Francis Gichuhi are prohibited from having contact with patrons while licensable activities are taking place.
- No free alcoholic drinks or shots are to be offered to patrons.
- Staff are prohibited from sexually propositioning or engaging in sexual touching with any patron.
The committee also agreed to amend the staff code of conduct condition, requiring that copies of the code of conduct be sent to both the police and Lambeth Licensing Service within one week of the hearing, and that any future amendments to the code be supplied to those authorities.
An additional condition was imposed, stating that members of staff are not to be in the company of a guest or customer except in areas of the club open to the public and used for licensable activities
. This condition was copied from the staff code of conduct.
The committee welcomed the commitment of the new DPS, Omar, to uphold the conditions and ensure that the venue's future culture, offer, and brand meet the high standards the public expects.
Any party has the right to appeal the decision within 21 days of the decision being published.
Arguments Made
Sergeant Richard Warren of the Metropolitan Police explained that meetings had taken place with Marcos Lavelle, the solicitor for the premises, as well as the previous and current DPS. All parties agreed that the interim steps were sufficient to allow the venue to continue to operate.
Councillor Emma Nye asked for clarity on why the police were not seeking a withdrawal of the licence, given the serious nature of the incidents. Sergeant Warren responded that the police understood that the business plan was changing, and that their concerns related to the culture of the management of the premises. The police were reassured that the change of management and the exclusion of Terry and Harry Georgiou from having contact with patrons would be sufficient to ensure the venue could be run safely.
Councillor Isla Wrathmell questioned whether the police would still have confidence in the venue remaining open if the type of music played did not change, as this was not a licensing condition. Sergeant Warren clarified that the police's concern was with the culture of the management, which had led to the vulnerability of females in the premises.
Marcos Lavelle, representing the licensee, stated that the premises and the police were in agreement on the proposed way forward. He explained that the changes that had been made, including the change in DPS and the implementation of a new staff code of conduct, were designed to ensure safety within the premises. He also noted that the police had expressed encouragement at the idea of a change in the nature of the music played and the clientele attracted.
Mr Lavelle also addressed a representation from a local resident, arguing that it did not specifically identify how Aquum was failing or resulting in violence on the street. He stated that the police had not brought the review due to Aquum failing and resulting in violence on the street, but rather due to a specific incident of serious sexual assault.
Additional Information
The committee was informed that an investigation was ongoing into what had occurred in the closed-off section of the premises.
The new DPS, Omar, has over 20 years of experience in hospitality, including a focus on welfare. He stated that he would be implementing the measures requested by the police and that he believed in creating a safe environment for women and LGBT customers.
The door supervision company employed by the premises is an acs approved contractor[^1].
Sergeant Warren offered to provide training on wave1 and ask angela2 to the committee members, so that they could better understand the training that the premises staff would be receiving.
