Summary
Licensing Panel A of Camden Council scheduled a meeting to discuss procedure for remote meetings, elect a chair, and consider two applications for premises licences. Councillor Sharon Hardwick, Chair of Standards Committee, Councillor Shah Miah and Councillor Patricia Leman, Deputy Mayor, were scheduled to be in attendance. The meeting was scheduled to be held remotely via Microsoft Teams and broadcast live via the council website.
KT&TT LTD, 55 Marchmont Street
The panel were scheduled to consider a report from the Executive Director Supporting Communities regarding an application from KT&TT LTD for a new premises licence at 55 Marchmont Street.
The application described the premises as a restaurant with Spanish cuisine set on two floors with a garden, with a maximum capacity of 59 guests.
The applicant requested permission to conduct the following licensable activities:
- Recorded music
- Anything of a similar description to recorded music
- Late night refreshment
- Supply of alcohol
The applicant proposed to conduct these activities between 8:00 and 23:30 Monday to Thursday, 8:00 and 24:00 Friday and Saturday, and 8:00 and 23:30 on Sundays, with an extension until 4:00 on New Year's Day.
The report pack included a letter from PC Juan Gomez of the Camden Police Licensing Team, confirming that the police would not be objecting to the application, provided that the applicant agreed to implement the following conditions:
- All CCTV recordings shall be stored for a minimum period of 31 days with date and time stamping.
- Viewing of recordings shall be made available immediately upon the request of Police or authorised officer throughout the entire 31-day period.
- A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises is open. This staff member must be able to provide a Police or authorised council officer copies of recent CCTV images or data with the absolute minimum of delay when requested.
- There shall be no vertical drinking. Alcohol will only be sold by waiter/waitress service to customers seated at tables.
- Alcohol sales will be ancillary to a substantial table meal.
- Police must be called to incidents of violence and/or serious disorder.
A representation was received from Adrian Brough, a resident of the Peabody Building directly behind the venue. Mr Brough raised concerns about noise and disruption, particularly if the outside space was used, and invited the panel to undertake a noise assessment. Mr Brough stated that he was a disabled individual with a chronic compromised immune system, and feared for his health and wellbeing if the licence was granted.
The report pack also included a document titled Appendices Combined
which contained the application form, a location map, the representation from Adrian Brough, and a list of conditions consistent with the operating schedule.
The Corner Lock, 31 Jamestown Road NW1 7DB
The panel were scheduled to consider a report from the Executive Director Supporting Communities regarding an application from Ei Group Limited for a new premises licence at The Corner Lock, 31 Jamestown Road NW1 7DB. The application sought identical hours to those held when the licence lapsed due to the insolvency of the previous tenant, TJM Leisure Ltd.
The application requested permission to conduct the following licensable activities:
- Supply of alcohol (for consumption both on and off the premises)
- Late night refreshments
- Recorded music
The applicant proposed to conduct these activities between 10:00 and 00:00 Monday to Saturday, and 12:00 and 00:00 on Sundays, with an additional hour on Friday, Saturday and Sunday preceding a Bank Holiday Monday, Maundy Thursday, Halloween, St Patricks Day, Christmas Eve, Christmas Day and Boxing Day, and from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day.
The report pack stated that the applicant had agreed conditions with the police responsible authority, and that the police had not made a representation to this application.
Ten relevant representations were received in relation to the application, from the Licensing Authority Responsible Authority, Resident Association and residents.
The report stated that the premises are situated in the Camden Town cumulative impact policy area where there is a presumption to refuse all new or variation applications, but that the presumption is rebuttable.
The report also stated that the hours policy is engaged by this application in relation to the proposed end times for licensable activities, with the exception of the provision of on sales on Friday and Saturday.
The report pack included a statement from Richard Taylor of Gosschalks, on behalf of Ei Group Ltd, in support of the application. Mr Taylor stated that the application sought to relicence the premises as the original premises licence lapsed following the insolvency and liquidation of Ei’s former tenant, and that the licence was not revoked due to any complaints or difficulties with the operation of the premises.
Mr Taylor stated that the applicant had agreed a number of additional conditions with the police, and that following that agreement the police did not object to the application.
Mr Taylor stated that a number of the representations received from residents did not oppose the grant of a licence per se, but rather the grant of late hours/extended hours, and that following the concerns of the residents, the requests for extensions (with the exception of New Years Eve) had been withdrawn.
Mr Taylor stated that the Licensing Authority representation was not an objection, but simply referred to the facts that the premises is within the CIP and the hours are (slightly) longer than the framework hours.
Mr Taylor stated that one local resident, Kate Tract, had withdrawn her representation following discussion over email and the agreement of two further conditions:
- A noise limiting device will be installed to the musical amplification system. The limiter will be set at a level agreed with an Environmental Health Officer so as to ensure that no noise nuisance is caused to local residents.
- All outside tables and chairs shall be rendered unusable by 22.00 hours each day.
The report pack included a list of proposed conditions, incorporating those agreed with the Police, Licensing Officer and Kate Tract.
Guidance on remote hearings held under the Licensing Act 2003 and associated regulations
The panel were scheduled to agree the procedure rules for remote meetings held under the Licensing Act 2003. The procedure rules included guidance on the system for conducting remote hearings, participation at the hearing, interruptions to connections, voting, confidential/exempt items, and equalities.
Election of Chair
The panel were scheduled to elect a Chair of Licensing Panel A for the 2025/26 municipal year.
Terms of Reference
The panel were scheduled to note the terms of reference of Licensing Panels. The terms of reference set out the matters delegated to the Licensing Sub-Committees (Panels) in respect of the Licensing Act 2003 and the Gambling Act 2005, as well as duties in relation to residual functions and the determination of miscellaneous licensing applications.
