The Licensing Sub Committee met to discuss a license variation for Chiave Shoreditch and a new premises license for Boundary Hotel Restaurant. The committee ultimately rejected the application for Chiave Shoreditch, but approved the application for Boundary Hotel Restaurant, with conditions. The committee also agreed to extend the decision deadline for several applications.
Chiave Shoreditch - Application for a Variation of a Premises Licence
The committee considered an application for a variation of a premises licence for Chiave Shoreditch, located at 36 Redchurch Street, London, E2 7DP. The applicant, Mr Orhan Cem Ozden, sought to extend the hours for the sale of alcohol and recorded music until 3:30 am on Thursday, Friday and Saturday.
The application received objections from the Licensing Authority, Environmental Protection, the Boundary Tenants and Residents Association, Shoreditch Masjid, and several residents. Concerns primarily focused on the potential for increased public nuisance, crime, and disorder in the Brick Lane Cumulative Impact Zone (CIZ).
Robert Sutherland, representing the applicant, argued that the premises was a small, niche music room cocktail bar with a capacity of 70, which they were willing to reduce to 50 after 2:00 am. He stated that the venue operated a strict guest list policy, with most patrons personally known to the owners, and that they had invested £300,000 in the venue. Mr Sutherland also highlighted an agreement with the police to reduce the timings to 3:30 am and employ Security Industry Authority (SIA) registered door supervisors. He offered a condition of no admissions or re-admissions after 1:45 am.
Corinne Holland, licensing officer, argued that the extension of hours would undermine the licensing objectives and that the applicant had not demonstrated exceptional circumstances to justify granting the application within the CIZ. Nicola Cadzow, noise officer, raised concerns about potential noise nuisance from patrons leaving the venue late at night.
Jonathan Mobley, Vice Chair of the Boundary Tenants and Residents Association, stated that Redchurch Street was becoming a nighttime economy link and that extending the licence would increase alcohol-related antisocial behaviour. Susanna Noe, chair of the Boundary Tenants and Residents Association, said that the area was already a high crime area and that more licences were being granted on Redchurch Street, to the detriment of residents.
Moebo Rahman, representing residents and Shoreditch Mosque, cited increasing noise nuisance, parking issues, and incidents of attacks believed to be linked to intoxicated individuals.
Councillor Amina Ali asked about mitigating potential anger from patrons who were not allowed re-entry after going outside for a smoke. She also raised concerns about the venue becoming an after party place
. Mr Sutherland responded that the small capacity and selective admissions process would prevent this.
Councillor Ali also asked whether the applicant had consulted with the local community. Mr Sutherland said that they had consulted with a person who lived next door and above the premises, and with their customer base.
When asked about their understanding of the CIZ, Céline Durian said that their security would prevent noise and crime, and that their customers were responsible and would leave quietly.
Councillor Ali said that the existing licence already exceeded the council's framework for community impact areas, and that she did not feel that enough reassurance had been given on why the framework should be extended further.
Mr Sutherland said that the last admission time and the reduction in capacity would create a wind-down period, and that the last alcohol sale could be at 2:30 am.
After hearing from all parties, the committee rejected the application.
Boundary Hotel Restaurant - Application for a New Premise Licence
The committee then considered an application for a new premise licence for Boundary Hotel Restaurant, located at 2-4 Boundary Street, London, E2 7JE. The applicant, Boundary Hotel Restaurant Limited, sought a licence for the sale of alcohol (both on and off sales) and to operate a hotel restaurant in the basement and ground floor of the hotel. The mezzanine level would not be licensed.
Simmi Yesmin, democratic services officer, announced that apologies had been received from the objectors, and that their written objections would be noted.
Lavine Miller-Johnson, licensing officer, introduced the report, noting that the application did not cover the roof terrace bar.
James McCulloch, director of the premises, explained that the application was to allow an external operator to run the restaurant, and that they were in talks with a Parisian brasserie operator. He said that if the new licence was granted, they would apply to remove the restaurant area from the existing hotel licence.
Mr McCulloch said that the hours they were applying for were lesser than the hours they were already licensed for.
Councillor Ali asked how the effectiveness of the measures would be monitored over time. Mr McCulloch responded that the lease with the restaurant operator would include terms to ensure compliance with the licence, and that the hotel had control over the operator.
There were no further questions from the committee.
With no objectors present, the committee moved to concluding remarks. Mr McCulloch said that the responsible authorities were happy with the operating schedule.
The committee granted the application as applied for, with the conditions.
Extension of Decision Deadline: Licensing Act 2003
The Sub Committee agreed to extend the decision deadline for the following applications to 30th June 2025:
