Mr Quadir also requested that condition 7 and condition 9 be removed from the licence, as they are covered by condition 10.

The report pack noted that the premises is located within the cumulative impact policy area for Hounslow and North West Isleworth, Heston and Cranford1.

The report pack included a statement from the applicant, Mr Mubeen Quadir, that the premises is a restaurant with alcohol sales tied to table meals, and that any extensions to operating hours would not undermine the licensing objectives. The statement also said that the premises are operated by experienced operators who operate very late opening premises in other boroughs with no adverse effects to the licensing objectives.

The report pack stated that Licensing Enforcement had submitted a representation based on the prevention of public nuisance and prevention of crime and disorder licensing objectives. The Licensing Enforcement proposed acceptable hours for the licensable activities and opening times, and conditions to supersede the current conditions. The Regulatory Enforcement Officer also submitted a representation relating to the possible effect of the extension of the hours on crime and disorder in the area and disturbance to the local community.

The Licensing Enforcement Officer, Charlie Hennessy, wrote that the Licensing Authority believed that the conditions offered by the applicant did not go far enough to address concerns raised from potential public nuisance, crime and disorder and the cumulative impact from the late operation of the proposed variation. Mr Hennessy wrote:

It is the view of the Licensing Authority that the applicant has not demonstrated the operation of the premises will not add to the existing cumulative impact in the Hounslow CIPA. It is therefore the Authority's recommendation that this application is not granted as applied for, but is modified with additional conditions applied to the licence proposed by the Licensing Authority to supercede the current conditions and the hours of operation amended from those sought

Mr Hennessy recommended the following hours of operation:

  • Recorded Music: Monday to Thursday 11:00 to 01:30, Friday and Saturday 11:00 to 02:00, Sunday 11:00 to 00:00
  • Performance of Dance: Monday to Thursday 11:00 to 01:30, Friday and Saturday 11:00 to 02:00, Sunday 11:00 to 00:00
  • Late Night Refreshment: Monday to Thursday 11:00 to 01:30, Friday and Saturday 11:00 to 02:00, Sunday 11:00 to 00:00
  • Supply of Alcohol: Monday to Thursday 11:00 to 01:30, Friday and Saturday 11:00 to 02:00, Sunday 11:00 to 00:00
  • Hours Premises are open to the Public: Monday to Thursday 11:00 to 02:00, Friday and Saturday 11:00 to 02:30, Sunday 11:00 to 00:30

Mr Hennessy also recommended additional conditions, including:

  • A comprehensive CCTV system
  • A staff member conversant with the operation of the CCTV system to be on the premises at all times when the premises are open
  • All staff responsible for selling alcohol to receive regular training in the Licensing Act 2003
  • An incident log to be kept at the premises
  • Notices to be prominently displayed at all exits requesting patrons to respect the needs of local residents and businesses and leave the area quietly
  • A challenge 25 proof of age scheme to operate at the premises
  • The licence holder to actively participate in any local pub watch or retail watch scheme that is in effect
  • No deliveries to take place between 21:00 and 06:00
  • No collections, including refuse and recyclable food waste to take place between 00:00 and 06:00
  • The use of the external area to cease at 00:00 Monday to Sunday
  • The supply of alcohol for consumption at the premises must be to a person seated and primarily for the purposes of taking a table meal there and for consumption by such a person as ancillary to their meal
  • Alcohol consumed outside the premises building shall only be consumed by patrons seated at tables
  • The supply of alcohol for consumption on the premises must be to a person seated and served by waiter/waitress service
  • A minimum of one SIA registered door supervisor shall be on duty on the premises between the hours of 21.00 until half an hour after closing on Friday and Saturday
  • Where SIA registered door supervisors are used at the premises, a record must be kept of their SIA registration number and the dates and times when they are on duty

A representation in support of the application was received from a business, who stated that they believed that Tiger Bay, the new venue, would bring significant benefits to the local economy, hospitality sector, and community.

Monitoring Officer Note on Interests

The report pack included a note from the Monitoring Officer reminding committee members to consider the categories of interests in the Members' Code of Conduct to determine whether they have an interest in any agenda item and any action they should take. It noted that if they have a disclosable pecuniary interest2 or other registerable interest in any matter being discussed at the meeting, they must declare the interest and not take part in any discussion or vote on the matter.

The report pack included the London Borough of Hounslow Statement of Licensing Policy 2020-25. The policy sets out the principles to be applied in considering applications under the Licensing Act 2003. It is designed to reflect local circumstances and characteristics whilst promoting the four licensing objectives: prevention of crime and disorder, public safety, prevention of public nuisance, and protection of children from harm.

The policy covers all premises in Hounslow where any of the following take place: sale or supply of alcohol, regulated entertainment, the provision of late-night refreshment, and supply of alcohol in qualifying clubs. It states that the Council supports the principle of flexibility in its approach to licensing hours and will consider the merits of each individual application. The hours for licensable activity will always reflect the individual merits of the application any relevant representations received as well as the requirement to promote the licensing objectives.

The policy also includes a cumulative impact policy for areas where the number, type and density of premises selling alcohol are high or exceptional, and serious problems of nuisance and disorder may be arising. The effect of adopting a cumulative impact policy is to create a rebuttable presumption, so that applications for new premises licences and club premises certificates or variations of these authorisations, which are likely to add to the existing cumulative impact will normally be refused or subject to certain limitations, following relevant representations being made.


  1. A cumulative impact policy area is a designated zone where the concentration of licensed premises is believed to be negatively affecting the local community. In these areas, applications for new licenses or extensions to existing ones face stricter scrutiny. 

  2. A disclosable pecuniary interest is a financial interest, or an interest relating to employment, office, trade, profession or vocation, that is significant enough to potentially influence a councillor's decisions. Councillors are required to declare such interests and may not participate in discussions or votes on matters in which they have a disclosable pecuniary interest.
