Summary

The Bromley Council Licensing Sub-Committee convened to discuss two temporary event notices (TENs) submitted by Mr Marco Pierluigi Bianchi for Pierluigi's, 86 - 90 High Street, Beckenham. The Public Health Nuisance Team had objected to both applications, citing concerns over the prevention of public nuisance due to ongoing enforcement action and previous issues with loud amplified music at the premises. The Licensing Sub-Committee was asked to determine the applications, considering Bromley's Statement of Licensing Policy 2025 to 2030 and representations from the applicant and objectors.

Pierluigi's Temporary Event Notices

The Licensing Sub-Committee considered two temporary event notices submitted by Mr Marco Pierluigi Bianchi, for Pierluigi's Pasta Fresca, located at 86 - 90 High Street, Beckenham, BR3 1ED. The applications sought to extend the hours for licensable activities on 9 and 16 August 2025, from 23:00 to 00:30, with the premises remaining open until 01:00 for dispersal.

The Director of Environment and Public Protection submitted a report regarding the applications for the temporary event notices.

The report noted that the Licensing Act 2003 states that any premises require a licence issued by the council where the following activities occur:

  • Provision of regulated entertainment
  • Provision of late night refreshment (between 23:00 and 05:00)
  • Supply of alcohol

The report stated that the council had received objections to both temporary event notices from the Public Health Nuisance Team. The Metropolitan Police had no objections.

The Public Health Nuisance Team formally objected to the temporary event notices, citing the prevention of public nuisance licensing objective. Their objection was based on the grounds that the premises were subject to enforcement action and a recent review of the premises licence due to loud amplified music. Despite ongoing appeals against an abatement notice1 and the licence review outcome, the team stated that they continued to receive complaints and had evidence to support them. The Public Health Nuisance Team cited the premises' history of non-compliance and the negative impact of loud amplified music on local residents.

According to the report, the premises has a history of issues, including:

  • December 2020: Two fixed penalty notices issued by police for breaches of Covid restrictions.
  • 21 April 2021: Prohibition Notice served for contravention of Covid restrictions.
  • 11 May 2021: £1,000 fixed penalty notice issued for contravention of Covid restrictions.
  • 8 July 2021: Letter sent advising no Regulated Entertainment can take place after 23:00.
  • 19 November 2021: Reports received that Regulated Entertainment is taking place after 23:00, further letter sent advising that it is not permitted by licence.
  • 8 April 2022: Warning letter issued regarding ongoing licence breaches with regard to Unlicenced Regulated Entertainment.
  • 14 May 2022: Noise Abatement Notice served.
  • 24 August 2022: Review of Premises Licence applied for by Public Health Nuisance Team, conditions added at hearing to address noise nuisance issues.
  • 9 February 2023: Closure Notice issued under section 19 of the Criminal Justice and Police Act 2001 for continuing to operate in breach of current premises licence.
  • 17 March 2023: Additional conditions added to licence following court procedure, including installation of noise limiting device with tamper evident seals.
  • 18 December 2023: Visit by Licensing Authority where it was discovered that the tamper evident seals on the noise limiting device had been broken.
  • 2 May 2024: CCTV footage requested by Licensing Authority for incident on 27 April 2024, with further requests made on 21 May 2024 and 18 June 2024.
  • 18 June 2024: Email from Licensing Authority regarding complaint of obstruction of the highway as additional items that were not permitted by the Pavement Licence had been placed on the pavement.
  • 29 January 2025: Review of Premises Licence applied for by Public Health Nuisance Team, currently subject to appeal at the Magistrates Court.

The report also included a complaint history from March 2024 to February 2025, detailing numerous instances of loud music and noise complaints.

The Licensing Sub-Committee had the option to grant the temporary event notices as applied or uphold the objections and refuse the applications by authorising the service of a counter notice.

  1. An abatement notice is a legal notice issued by a local authority to stop a nuisance.
