A representation form from Roshnee Chavda of Development Management, Liverpool City Council, stated that while the use of the premises as a convenience shop was acceptable from a planning point of view, Planning objected to the extended opening hours for the sale of alcohol, as these could have an unacceptable negative impact on residential amenity of neighbouring properties .

A representation form from a local resident stated that:

The use of a licensed shop to sell alcohol will only fuel more crime and disorder in the Walton vale area. The location of the premises in question is directly on the corner of Windsor Road a busy traffic area. Above the premises and adjacent to the premises has been an issue with drug use and selling drugs from this area.

The resident also stated that they were in discussion with the local Walton MP regarding antisocial behaviour and HMOs2 in the community.

The sub-committee was scheduled to discuss an application submitted by St. Domingo's Bar Limited for a premises licence for 66 Regent Road, Liverpool, 5. The premises was described as a public house. James Williams was named as the designated premises supervisor.

The proposed hours of licensable activity were:

  • Licensable Activities (indoors) of Films, Indoor Sporting Events, Live Music, Recorded Music and entertainment of a similar nature: Sunday to Thursday 09:00 to 00:00, Friday and Saturday 09:00 to 01:00
  • Supply of alcohol on and off the premises: Sunday to Thursday 09:00 to 00:00, Friday and Saturday 09:00 to 01:00
  • Seasonal Variations: One hour extension on Christmas Eve and Boxing Day
  • Non-standard timings: An extension on New Year's Eve until recommencement at 09:00 on New Years Day. An hour's extension for Everton home games. An hour's extension for Bank Holiday Sundays into Monday.

The report pack noted that conditions had been agreed with Merseyside Police and Environmental Health. The conditions agreed with Merseyside Police were:

  1. When Everton Football Club men's first team play at home or any international football matches are being played there will be a minimum of one SIA door supervisor per open floor. Starting a minimum of two hours before the match commences and remaining on duty until one hour after the match.
  2. Whilst on duty, all door supervisors shall be capable of communicating instantly with one another by way of radio or other simultaneous system of communication.

The conditions agreed with Environmental Health were:

  1. There will be no external speakers allowed, this will include any attached to the fabric of the premises
  2. If the Council receives noise complaints about regulated entertainment at the premises which are substantiated as likely to undermine the licensing objective of prevention of public nuisance, then further measures must be considered to remedy the noise issues. These measures may include one or more of the following:
    • the fitting of internal secondary doors to the main ingress and egress routes of the premises
    • the fitting of a noise limiting device to all amplification equipment within the premises (with levels to be set in conjunction with an officer from the Environmental Health Service)

According to the report pack, a representation had been received from Planning and Building Control.

A representation form from Katy Owen of Planning & Building Control stated that the site has planning permission for use as a bar (ref 24F/3077). The approval set the following restrictions on opening hours via condition 5:

  • 11am-midnight Monday to Friday
  • 10am-midnight Saturdays, Sundays, and Bank Holidays

Katy Owen stated that these restrictions are crucial in preventing public nuisance. Condition 11 of the planning permission requires that there be no amplified music generated outside of the premises, and that the level of any incidental amplified sound escaping from the premises shall not exceed existing background noise levels.
