The Fenland District Council Licensing Sub-Committee convened to consider an application for a new private hire vehicle driver's licence. After reviewing the applicant's record and considering the Hackney Carriage and Private Hire Licensing Policy 2021-26, the sub-committee determined that the applicant was not a fit and proper person to hold such a licence, and the application was refused.
Private Hire Vehicle Driver's Licence Application
The sub-committee considered an application for a new private hire vehicle driver’s licence. The applicant had a previous conviction from 5 January 2024, which resulted in a fine and six penalty points on their driving licence. Because of the conviction, the application was referred to the Licensing Sub-Committee to assess whether the applicant met the standard of being a fit and proper person to hold a Private Hire Vehicle Driver’s Licence.
The sub-committee reviewed a report from the Licensing Officer and heard from the applicant. They considered relevant legislation, statutory guidance from the Department for Transport, and non-statutory guidance from the Institute of Licensing, as well as the council's Hackney Carriage and Private Hire Licensing Policy 2021-26.
The sub-committee noted that the safety of the public is the primary concern when assessing an applicant's suitability, and that a high standard is expected of all Private Hire Vehicle Driver Licence applicants. While acknowledging the applicant's honesty in disclosing the offence and admitting guilt at the time, the sub-committee had concerns about the recent nature of the conviction.
The Institute of Licensing's guidance suggests a five-year period should elapse since the conviction or completion of any disqualification. The sub-committee felt that the full five years was not necessary in this case, but that more time should pass without further offences before the applicant would be considered fit and proper.
Ultimately, the sub-committee decided to refuse the application.
