The Licensing Enforcement Sub-Committee met to discuss a personal license review. The committee decided not to revoke the personal license at this time, and will invite representations from the Chief Officer of Leicestershire Constabulary regarding whether the license should be suspended or revoked. The committee will then consider the matter again and reach a final decision.
Personal License Review
The Director of Neighbourhood and Environmental Services submitted a report to the sub-committee regarding a review of a personal license issued by the council. The Licensing Act 2003 regulates the sale and supply of alcohol, and personal licenses are required for individuals who authorise the sale of alcohol in licensed premises.
Bobby Smiljanic, Team Manager (Regulatory Services) presented the report, outlining the details of the application and relevant City Council guidelines. The personal license holder, who was present with his wife, addressed the sub-committee and answered questions from members and officers.
The sub-committee received legal advice and were advised of the options available to them and the relevant policy and statutory guidance.
The sub-committee decided not to revoke the personal license at this stage. Notice will be given to the Chief Officer of Leicestershire Constabulary, inviting representations regarding whether the personal license should be suspended or revoked, having regard to the crime prevention objective1, under section 132A(10) of the Licensing Act 2003. Leicestershire Constabulary has 14 days to make representations, after which the committee will reconsider the matter.
The personal license holder will be provided with the reasons for the decision in writing within five working days, and all parties will be advised of their right to appeal the decision.
Private Session
The sub-committee resolved to exclude the press and public from the meeting during consideration of some reports. This was done in accordance with Section 100A(4) of the Local Government Act 1972, as the reports contained exempt information as defined in Part 1 of Schedule 12A of the act. The specific exemptions cited were paragraphs 1, 2, 3, and 7, relating to:
- Information relating to any individual.
- Information likely to reveal the identity of an individual.
- Information relating to the financial or business affairs of any particular person (including the authority).
- Information relating to action taken or to be taken in connection with the prevention, investigation, or prosecution of crime.
The sub-committee considered that the public interest in maintaining the information as exempt outweighed the public interest in disclosing it.
