The South Hams Licensing Sub-Committee met to consider an application to vary the premises licence for Challaborough Bay Holiday Park, and to determine whether to modify the licence conditions, or reject the application. Twenty-five representations had been received regarding the application, and the sub-committee was scheduled to consider these.
Challaborough Bay Holiday Park Licence Application
The sub-committee was scheduled to consider an application from Parkdean Holiday Parks Limited to vary the premises licence at Challaborough Bay Holiday Park, Challaborough Beach, Kingsbridge.
The public reports pack included a recommendation that the sub-committee consider the application and make a determination, namely to:
i) modify the conditions of the licence; ii) reject the whole or part of the application
The application sought to:
- Change the premises name to Challaborough Bay Holiday Park, removing references to 'Waterfront Bar' and 'Christies'.
- Amend the hours for the sale of alcohol for consumption on and off the premises to 10:00 to 00:00 Sunday to Thursday, and 10:00 to 02:00 Friday and Saturday.
- Amend the hours for regulated entertainment1 indoors to 10:00 to 00:00 Sunday to Thursday, and 10:00 to 02:00 Friday and Saturday.
- Amend the hours for late night refreshment to 23:00 to 00:00 Sunday to Thursday, and 23:00 to 02:00 Friday and Saturday, extending this to both indoors and outdoors.
- Apply the first set of opening hours shown on the current licence to the entire site: 08:00 to 00:30 Sunday to Thursday, and 08:00 to 02:30 Friday and Saturday.
- Include indoor sporting events between 10:00 and 00:00 Sunday to Thursday, and 10:00 to 02:00 Friday and Saturday.
- Add live music to be permitted from the end of licensed hours on New Year's Eve to the commencement of licensed hours on New Year's Day.
- Extend all licensable activities and opening hours by one hour on the day when British Summertime commences.
- Extend all licensable activities to 08:00 to 02:00 on Sundays preceding a Bank Holiday Monday, with opening hours of 08:00 to 02:30.
- Amend the premises licence plan to add the Chip Shop and the outdoor seating areas to be licensed for sale of alcohol and late night refreshment.
- Amend and remove outdated conditions to be replaced with more appropriate conditions.
The application to vary the premises licence stated that the applicant intended to take additional steps to promote the four licensing objectives2, including:
- Employing door supervisors, with records kept of their identity, SIA3 licence number, and times on duty.
- Providing training to anyone authorised to sell alcohol, including information on how to prevent underage sales.
- Keeping a record of every refusal to sell alcohol to a person who is drunk or appears to be under 18 years of age.
- Maintaining CCTV equipment and recordings for a period of 31 days.
- Ensuring a first aider is available on the holiday park during trading hours.
- Keeping all external doors and windows shut when events involving amplified music are taking place.
- Operating a Challenge 25 age policy.
The public reports pack noted that twenty-five representations had been received from local residents, district councillors, local parish councils and a local residents association. Concerns raised in the representations related to all four of the licensing objectives, but predominantly to the prevention of public nuisance. Frequent concerns included the proposal to use the Waterside Bar area of the premises later into the night, as well as the inclusion of the adjoining outside seating area and the take-away as areas where supply of alcohol and late night refreshment may take place.
The public reports pack stated that the sub-committee would need to consider the hours of operation proposed, the effectiveness of the operating schedule proposed by the applicant, the representations received, the location of the premises in relation to residential properties, the history of the management of the premises, the evidence provided of any problems in the past, the likely impact of any extension of hours and activities, public transport, taxi availability, the right the applicant has to operate a business and balancing the rights of residents to the quiet enjoyment and privacy of family life.
