PC Lund noted that the application made no mention of these provisions, and that if granted, the premises would be able to conduct licensable activities until 3am without providing door staff, which PC Lund believed would lead to an increase in alcohol fuelled crime and disorder.

There is also a greater risk to public safety as individuals become increasingly vulnerable due to intoxication which increases the chance of them being a victim of crime or needing medical treatment for injuries sustained.

PC Lund recommended that the Licensing Authority serve a counter notice unless conditions that mirror the premises licence were added to the TEN.

The Public reports pack stated that the Licensing Committee could decide to:

  • Allow the licensable activities to go ahead as stated in the Notice; or
  • Impose one or more of the existing licence conditions on the TEN if it considers that this is appropriate for the promotion of the licensing objectives; or
  • Decide that the event would undermine the licensing objectives and should not take place and issue a Counter Notice to the TEN.
