The Licensing Sub-Committee of Wyre Borough Council met on Monday, 29 September 2025, to consider a report regarding Temporary Event Notices (TENs) for The Cube, a bar and restaurant in Poulton-le-Fylde. Objections to the TENs had been received from Lancashire Police. The committee was asked to determine the Temporary Event Notices in accordance with the Licensing Act 2003, Wyre Council Statement of Licensing Policy 2021-2026 and the Home Office Guidance issued under Section 182 Licensing Act 2003.
Objection to a Temporary Event Notice in respect of The Cube, 2 Breck Road, Poulton-le-Fylde
The Licensing Sub-Committee was scheduled to consider Temporary Event Notices (TENs) submitted by Danielle Mellor of The Cube, 2 Breck Road, Poulton-Le-Fylde, to cover licensable activities on 1, 2, 29 and 30 November 2025.
The report for discussion noted that Lancashire Police had submitted objection notices against the TENs, citing concerns over the Prevention of crime and disorder and Public safety. According to the report pack, PC Matt Lund of Lancashire Police had objected to the notices on the grounds that the proposed events would undermine the licensing objectives.
The report pack included copies of the existing premises licence PL(A)0342, the relevant Temporary Event Notices, and the Police objection notices.
Background to the Temporary Event Notices
According to the report, Ms Mellor, the 'premises user', submitted Temporary Event Notices TEN000752 and TEN000753 on 18 September 2025. These notices requested permission to extend regulated entertainment and the sale of alcohol between 02:00 hours and 03:00 hours on 1, 2, 29 and 30 November 2025. If approved, the notices would extend the existing opening hours to 03:30 hours on those dates.
Key Issues
The report pack clarified that a Temporary Event Notice is a notification that licensable activities will occur at a venue at specific times, rather than an application. The report pack noted that the limit on numbers at such an event is 499 people. It also noted that the Police and Environmental Health have the right to object if they believe the event would undermine any of the licensing objectives1.
The report pack stated that it was:
inappropriate for officers of the Licensing Authority involved in the administration of notices to make recommendations. Members should note that at any time prior to the hearing, the Police may, with the agreement of the premises user, modify the notices by making changes to them.
The report pack outlined possible actions available to the Licensing Committee:
- Allow the licensable activities to proceed as stated in the Notices.
- Impose one or more of the existing licence conditions on both TENs if it considers that this is appropriate for the promotion of the licensing objectives.
- Decide that the events would undermine the licensing objectives and issue a Counter Notice to them.
Police Recommendations
The Police recommended that a Counter Notice be served unless certain restrictions or requirements mirroring the premises licence were added as conditions to the TENs. These conditions included measures related to:
- CCTV installation, maintenance, and operation.
- The presence of a staff member conversant with the CCTV system.
- Notification to the Police Licensing Unit when the CCTV or radio system is inoperative.
- Display of signage alerting customers to CCTV recording.
- Bi-annual maintenance checks of the CCTV system.
- Enforcement of the Challenge 25 proof of age policy2.
- Staff training on serving drunks and conflict management.
- Maintenance of an incident book.
- Security arrangements to discourage drug sale and consumption.
- Maintenance of records of incidents involving drugs.
- Procedures for storing, disposing of, or transferring confiscated drugs in accordance with Lancashire Constabulary procedures.
- Presence of a personal licence holder on the premises after 21:00 hours.
- Adult supervision of children under 12 and restrictions on children under 18 after 21:00 hours.
- Prohibition of functions targeting young people aged 17-18, except for supervised events organised by Educational Establishments.
- Prohibition of entertainment of an adult or sexual nature.
- The presence of SIA3 door supervisors, with numbers determined by customer numbers and risk assessments.
- Restrictions on entry with drinks and the use of non-splintering containers.
- Maximum permitted numbers of people on each floor.
- Membership in a Pub and Club watch scheme.
- Maintenance of records relating to health and safety, fire safety, and crime and disorder.
- Operation of a dispersal policy.
- Compliance with the Portman Group Code of Practice4.
- Provision of adequate lavatory accommodation.
- Restrictions on deliveries and waste removal times.
- Measures to prevent offensive smells and proper waste disposal.
- Suitability of entertainment for children.
- Implementation of a dispersal policy agreed upon with the Police.
- Measures to prevent noise nuisance.
- Closure of external doors and windows during regulated entertainment.
- Noise level restrictions.
- Regular noise assessments.
- Notices requiring customers to leave quietly.
- Restrictions on lighting causing nuisance.
- Restrictions on the use of the outside area after certain hours.
- Regular checks of the outside area.
- Waiter/waitress service only in the outside area.
- Seating requirements for customers consuming alcohol in the outside area.
- Prohibition of live entertainment, live music, or recorded music in the external licensed area.
- Use of an electronic/computerised ID monitoring system.
- Service of drinks in polycarbonate or non-glass vessels after midnight.
- Drug awareness training for staff.
- Display of notices regarding customer searches and informing police about controlled substances or weapons.
- Exclusion of customers with previous drug-related convictions.
- Searches for drugs when there is reasonable suspicion.
- Random drug searches of 10% of customers after midnight.
- Visible display of SIA door staff badges.
