Terms of Reference

  PURPOSE   PC1      To exercise all the powers and duties of the Council as the Local Planning Authority.   CORE FUNCTIONS   PC2      To respond to consultation documents in relation to changes to national planning legislation, regulations and policies and the plans, proposals and strategies of other organisations and businesses that have spatial planning implications or would impact on the environment, economy and communities of the islands.   Exceptions: The following decisions are reserved to the Council. a)                  the adoption of Local Plans. b)                  the withdrawal of Conservation Area Status. c)                  any decision involving possible financial compensation including the          acceptance of purchase notices and the discontinuance, modification or   revocation of planning permission. d)                  any significant planning legislation which potentially affects the environment       of the Islands.   PC3      To decide planning applications that are not reserved to the Planning Officer   PC4      To review the delivery of the AONB Management Plan and the implementation of AONB services.   PC5      To formulate and implement the public consultation on the Local Plan and present the findings to Council for consideration.   PC6      To manage Key Worker functions, applications, reviews, and scrutiny   PC7      In the context of planning policies to determine the definition and make assessments in relation to those with a specific local need and key workers.   PC8      To appoint to and manage ad-hoc sub-committees relating to any of the above functions.   PC9      To set the committee's fees and charges.   MEMBERSHIP   PC10    Membership of the Planning Committee shall be decided at each Annual Council.  The Chairman and Vice-Chair will be elected annually at the first meeting of the committee following Annual Council.

  PC11    Membership can include all Elected Members of the Council of the Isles of Scilly.

  VOTING RIGHTS   PC12    Only Local Authority Members can vote on any issue providing they do not have a disclosable pecuniary interest in a matter.   PC13    Non-Local Authority Members appointed to the committee can vote on any matter except for decisions pertaining to budget decisions of the Council of the Isles of Scilly.   PC14    The Duchy of Cornwall and the Isles of Scilly Wildlife Trust have observer status on the committee, with no voting rights.
