CONCISE LEGALISTIVE HISTORY OF THE COUNCIL OF THE ISLES OF SCILLY We were previously a district for some functions under Cornwall Council, previous to 1890. The Council of the Isles of Scilly as we know it was set-up in 1890, under the Local Government Act 1888, by virtue of the Local Government Board’s Provisions Order Confirmation (no6) Act 1890. At this point, we were designated a rural district council. A map was made, called ‘Map of the Isles of Scilly 1890’, which showed each ‘parish’ area, for each island. The council was to consist of a chairman, four aldermen, and 20 councillors. Bryher – 1 councillor Saint Agnes – 2 councillors Saint Martin’s – 2 councillors Saint Mary’s – 12 councillors Tresco – 3 councillors This was then followed-up by the Isles of Scilly Order 1943, which was made under the Local Government Act 1933. Everything changed following the Isles of Scilly Order 1978, which was made under the Local Government act 1972, because section 265 of that act made clear that the Isles of Scilly was to be treated separately to the rest of England and Wales, and said that an Order from the sec of State would determine Scilly’s functions… but the first of these did not come until 1978. The following Orders have been made under s265 of the 1972 act: • Isles of Scilly (functions) (adoption and children act 2002) Order 2010, si 2010/1134. • Isles of Scilly (functions) (no 2) Order 1982, si 1982/1659. • Isles of Scilly (functions) Order 1979, si 1979/72. • Isles of Scilly (functions) Order 1982, si 1982/701. • Isles of Scilly (functions) Order 1991, si 1991/205. • Isles of Scilly (functions) (review and scrutiny) Order 2013, si 2013/643. • Isles of Scilly (members' allowances) Order 1991, si 1991/446. • Isles of Scilly Order 1978, si 1978/1844. The 1978 Order changed the names of ‘Saint’ to ‘St’, with regard to Agnes, Martin’s and Mary’s. The Order also changed our numbers to the following: Bryher – 2 St Agnes – 2 St martins – 2 Tresco – 3 St Mary’s – 16 We then underwent a further change following the lesser-spotted Isles of Scilly (Amendment) Order 1984. This Order is not listed online, it seems to exist only in paper form, and it changed our councillor numbers from 25 to 21, with 2 on each off-island and 13 on St Mary’s. This remained in place until the boundary commission review of the islands resulted in the Isles of Scilly (Electoral Changes) Order 2017, where each off-island was reduced to 1 councillor, and St Mary’s was reduced to 12.
