Content: By unanimous vote, the Committee approved the application subject to: · The planning conditions set out in the officer’s report with minor amendments to the conditions as drafted delegated to officers; including o an amendment to the wording of condition 21 detailed in the Amendment Sheet as follows: Each dwelling in the development hereby permitted shall only be constructed as a self-build or custom build dwelling as defined by the Self-Build and Custom Housebuilding Act 2015, as amended by the Housing and Planning Act 2016 (as amended). Occupation of each dwelling shall comply with all the following: 1. First occupation shall be by a person(s) registered with the Council and recorded on the register maintained pursuant to section 1 of the Self-Build and Custom Housebuilding Act 2015 (as amended), who had a primary input into the design and layout of the dwelling, who’s occupancy is their primary residence, and their dependents or members of their usual household who ordinarily reside with the registered occupant. 2. For a period of no less than 3 years from first occupation, any subsequent occupation shall only be to a person(s) registered with the Council and recorded on the register maintained pursuant to section 1 of the Self-Build and Custom Housebuilding Act 2015 (as amended), and their dependents or members of their usual household who ordinarily reside with the registered occupant. No later than 8 weeks prior to first occupation, details of the person(s) who will take up first occupation of each dwelling in the development in accordance with criterion (1) above, shall be submitted to and approved in writing by the Local Planning Authority. First occupation shall not take place until such details have been agreed in writing by the Local Planning Authority. First occupation shall be in accordance with the approved details. Reason: To ensure the development complies with the Self-Build and Custom Housebuilding Act 2015, as amended by the Housing and Planning Act 2016, and to help to meet the Council’s self-build requirements, in accordance with paragraphs 71 and 73 of the National Planning Policy Framework 2024.
