Purpose: On the 22 July 2025 Cabinet gave permission to establish a five Lot, ILSS Framework Agreement, to commence on the 6 October 2025. Following this approval, notification letters were issued to the un/successful Bidders.   The Council received multiple challenges. Upon review, flaws in the moderation process and content of the notifications were identified, and on the 11 September 2025, the Chief Executive in partnership with The Mayor and Chair of Overview and Scrutiny gave permission to abandon the tender, and the extend the current arrangements by a month.   This paper seeks permission to further extend the current arrangements whilst the procurement exercise in re-run.

Content: For the reasons set out in this report and its appendices, Cabinet RESOLVED to Agree to:   i)  Extend the: (a) ILSS Framework Agreement; (b) Home Care Dynamic Purchasing System; (c) Dynamic Purchasing System platform (sproc.net) until the 31 May 2027 as set out in section 4 of this paper; and waive any requirements of Contract Standing Orders as necessary. ii)  Delegate authority to the Interim Corporate Director of Adults and Health, in consultation with the Cabinet Member for Adult Social Care and Health to finalise and enter into all documentation to give effect to the decision at 3.1(a). iii)  Delegate authority to the Corporate Director of Children’s and Young People’s Services, in consultation with the Cabinet Member for Children and Young People’s Services to finalise and enter into all documentation to give effect to the decision at 3.1(b) and 3.1.(c). iv)  Delegate authority to the Interim Corporate Director of Adults and Health and Corporate Director of Children and Young People’s Service in consultation with the Cabinet Member for Adult Social care and Health and Cabinet Member for Children and Young People’s Services to finalise the new procurement design and approve commencement of the procurement. This will take place after a review, in which internal audit have been asked to assist.   Alternatives considered   a)  There are no alternatives, due to the statutory duty to provide Home Care.
