Options considered and rejected were: There are no options that were considered due to the statutory nature of the role. Assessment of risk: Failure to cover a period of sickness exposes the Council to significant risk as it may lead to a breach of our statutory duties and the requirement to fulfil core adult social care functions. Without appropriate cover, the council may be unable to assess local needs, ensure delivery of essential care and support services, or meet required standards, heightening risks around prevention, early intervention and safeguarding vulnerable adults from abuse or neglect. The absence of leadership could also impact governance and partnership working across health, police, providers and voluntary sectors and exposes the authority to potential legal challenge and reputational damage. The source of funding is: The extension will be funded from Council reserves. Once approved by Council. Legal advice obtained: Failure to maintain a statutory post holder would expose the Council to legal non?compliance, potential judicial review challenges, and increased scrutiny from regulators such as CQC if it is judged that there is insufficient leadership oversight. Financial advice obtained: The current year spend has been included with the forecast Council financial position. The extension up to end of May 2026 will be managed through the additional one-off reserve ask reflected within the 2026/27 budget for approval at Council on 25th February 2026. Procurement advice obtained: The original contract for the Interim Exec Director of Adult Social Care and Health Partnerships with Tile Hill was awarded through a direct award from the LGRP framework which is a public framework established by YPO and the London Borough of Waltham Forest. That framework expired in November 2025, and the next iteration of the framework is due to go-live in March 2026. There are a number of other frameworks available to use, and the extension of this contract could be facilitated by either an extension to the original contract or making an award via another public procurement framework. Following approval at Procurement Board the procurement team will assist the commissioner in establishing the best route to extend the contract. HR advice obtained: This role is a statutory role which cannot be left vacant without risk or potential challenge. This is a further extension of the current interim arrangements are required to support a period of absence and a phased return. Arrangements need to be extended to support with continuity of leadership during this period of transformation within Adult Social Care.
