(to be supplied by procurement) Direct Award – Sole Provider Framework Details (where applicable) (procurement body, framework reference & title, start/ end date Yorkshire Purchasing Organisation (YPO) Amazon Digital Market Place - 1142 Funding Source Revenue Budget Ethical Contractor (EC): Mayor’s Employment Charter     EC: Committed to sign up to charter EC: Accredited Living Wage Employer   The Reasons are:   Options considered and rejected were:   Assessment of Risk: None.   The source of funding is: Revenue Budget.   Legal Advice obtained: The Shared Legal Service When commissioning contracts for the procurement of goods, services or the execution of works, the Council must comply with the requirements of the Public Contracts Regulations 2015 (PCR) and its own Contractual Standing Orders (CSO’s) failing which the decision may be subject to legal challenge from an aggrieved provider. CSO’s stipulate that where a suitable framework exists, this must be used unless there is an auditable reason not to do so.   A framework is an overarching agreement through which named user organisations can require a service/supply from a number of providers by undertaking a call off exercise to meet its requirements by further competition or direct award as applicable and enter into an individual contract/agreement with that provider, according to the terms of the framework agreement within the lifespan of the framework. A contract will be formed between the Council and chosen provider based on the call off contract terms specified in the framework.   The YPO Framework allows public bodies to use it and the Council should ensure that it has complied with the requirements of the framework in awarding this contract to Amazon UK Services Ltd. The YPO Framework complies with the PCR and CSO’s. The award also delivers savings and efficiencies as detailed in the report.   Financial Advice obtained: David R Mills, Strategic Finance Manager, 16 July, 2024. The report is seeking the appointment of Amazon UK Services Limited for a period of 29 months with an average spend of £72,000 per annum.   The spend comes within the general revenue spend of each Directorate and all such spend is managed in accordance with the authorisation limits set within the Constitution.
