Purpose:
Content: Committee approved as a correct record the Minutes of the Meeting of 02 July 2024 subject to the following amendment at Item 6, paragraph 8: During debate Cllr Black advised that she understood the need for the facility but that she had concerns about the safety of the location. She advised that she was inclined to support the application to enable it to be referred to the Scottish Ministers who, in turn, could look at the HSE position in more detail. The Monitoring Solicitor reminded the Committee of the requirement for any Motion to be based on Planning Policy. Cllr Black advised that she would require a short recess to formulate the appropriate Motion. Cllr Stelfox moved to agree the officer recommendation to refuse the application. Cllr Agnew seconded that Motion. The Committee agreed to a short recess to enable Cllr Black to consider the wording of her Amendment. Following recess, the Monitoring Solicitor reported that, during the short recess the Planning Officer had advised her that HSE have previously advised that, if requested to do so, they would be prepared to attend Committee meetings to provide further information to Committee Members. The Monitoring Solicitor further reported that she had provided Members, during the recess period, with this information and legal advice confirming that it would be competent to defer consideration of this application to a later date should Members wish to invite HSE to attend and answer any queries Members may have. Cllr Stelfox withdrew his Motion. The Committee agreed to defer the item to an Area Committee following the vacation period in order to invite the HSE to attend to respond to any queries Members have.
