This meeting was scheduled to include a review of the minutes of the previous meeting, and to consider whether to review the Private Hire Vehicle Driver's Licence of a driver, referred to only as 'the licence holder'.
Review of a Private Hire Vehicle Driver's Licence
The committee was scheduled to consider whether to review the licence of a driver. The report pack included for discussion contains a reminder of the rules that the committee has to follow when making such decisions, which are set out in Schedule 12A the Local Government Act 19721.
The public are likely to be excluded from the meeting for consideration of the following item on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1 and 2 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).

The report pack also reminds the committee of the range of sanctions that are available to it under the Local Government (Miscellaneous Provisions) Act 19762, and that it is possible for the driver to appeal the committee's decision.
The options available to the sub-committee when considering such information were: To take no action. To warn the licence holder regarding their future conduct. To add additional conditions to the licence. To suspend the licence for a set period of time. To revoke the licence. Should the sub-committee revoke the licence or impose additional terms, conditions or restrictions then the licence holder may appeal to the Magistrates Court within 21 days from the date on which they were notified of the decision. Should the Magistrates uphold the decision of the council, the licence holder had further recourse to the Crown Court.
