Summary

The Licensing (Hearings) Sub-Committee met to consider an application for a new premises licence. The agenda for the meeting included an application for a new premises licence for La George, 239 Narborough Road, Leicester. The sub-committee was scheduled to determine whether to grant the licence, grant it with conditions, exclude licensable activities, refuse the proposed premises supervisor, or reject the application.

Application for a New Premises Licence - La George, 239 Narborough Road, Leicester

The Director of Neighbourhood and Environmental Services submitted a report outlining an application from La George LTD for a new premises licence for La George, 239 Narborough Road, Leicester.

The application requested the ability to sell alcohol (off-licence) and remain open from 08:00 to 23:00, Monday to Sunday. The applicant, represented by Anthony Close of AC Consultancy, stated that the premises would promote the licensing objectives in accordance with Section 182 Guidance1 of the Licensing Act 2003.

Six representations were received from members of the public, raising concerns about the prevention of crime and disorder, prevention of public nuisance, and public safety. The representees expressed concerns that another business in the area would exacerbate existing problems, leading to increased anti-social behaviour, litter, parking issues, and vandalism.

The report noted points for clarification from both the applicant and those who made representations:

By the applicant

  1. Whether the applicant considers that the concerns outlined in the representations are valid, and if not why not.
  2. In the light of the representations made, whether the applicant wishes to propose any additional steps for the promotion of the licensing objectives.

By the party making the representation

  1. Whether they have any additional information to support the representation they have made.
  2. Whether there are any additional steps that could be taken which would be equally effective in the promotion of the licensing objectives.

Appendix C of the report detailed conditions consistent with the operating schedule, including:

  • Staff training on their roles and responsibilities.
  • A 12-camera CCTV system with visible monitors and warning signs.
  • Retention of CCTV recordings for a minimum of 31 days, accessible to the Police and Local Authority Officers.
  • A refusal register to record incidents.
  • Provision of a waste bin and daily sweeping of the front pavement.
  • Display of notices requesting customers to leave quietly.
  • A maximum of 3 unaccompanied children allowed in the shop at any one time.
  • Implementation of Challenge 252 and Pass approved notices for age-restricted products.

In additional hearing notes, Anthony Close of AC Consultancy, agent for the applicant, stated that the letters of objection were of a very similar style, nature and content and are mainly outside the scope of The Licensing Objectives. He also noted that a large bin is positioned at the front door of the shop, and that a modern CCTV system is installed with 12 high resolution cameras to pick up and record any incidents.

Anthony Close of AC Consultancy, agent for the applicant, concluded:

The application meets all statutory requirements. The Operating Schedule gives details of how the premises will promote the Licensing Objectives. Previously this was an empty shop, which has been completely refurbished to become a lifestyle convenience store. With freshly baked bread and cakes, a wide range of essentials and a 7 Metre butcher’s counter (please see photo enclosed) After opening a few weeks ago it is proving to be a very popular shop. Over 50 customers have signed a document giving their support to this application.

  1. Section 182 Guidance refers to guidance issued under section 182 of the Licensing Act 2003, which provides advice to licensing authorities on how to carry out their functions under the Act.

  2. Challenge 25 is a retailing strategy used to prevent the sale of age-restricted products to underage people. If a customer looks under 25, they are asked to provide proof of age.
