The Islington Council Licensing Sub Committee D met to discuss new premises licences for Sud Italia and West 25. A decision on Sud Italia was deferred, while the application for West 25 was granted with amended conditions.

West 25, 125 Packington Street - New Premises Licence Granted

The committee granted a new premises licence for West 25, 125 Packington Street, with conditions. The licence allows for the sale of alcohol, recorded music, and late-night refreshment.

Several local residents attended the hearing to voice their objections. Concerns were raised that the area already had a number of late-night alcohol vendors, and that the premises was located on the edge of a cumulative impact area¹. There were also concerns about littering, drinkers on the street, and the premises being located opposite a school, meaning parents would be waiting in the same area as smokers from the premises.

The applicant's legal representative stated that the revised operating schedule had been submitted and that the premises was not located in a cumulative impact area. They explained that the business was intended to be a bar/pub, and whoever the freeholder would lease it to would be bound by planning permission to use the premises predominantly as a bar/pub.

The Sub-Committee agreed to the following amended conditions:

• Off sales would only be permitted with or after a substantive meal and in sealed containers.
• The smoking area must be away from the entrance to the residential flats.

The Sub-Committee noted that the legal representative for the freeholder agreed to submit an application to transfer the premises licence from the applicant to the freeholder.

The Sub-Committee considered Licensing Policy 5, which allows the Licensing Authority to impose further limitations on hours where it was appropriate to promote the licensing objectives, and Licensing Policy 6, which allows the Licensing Authority to give more favourable consideration to applications with the opening and closing times that were within 'Framework' hours.

The Sub-Committee was satisfied that the operating schedule demonstrated high standards of management and that the proposed use, with the extensive conditions agreed and amended, meant that the premises would promote the licensing objectives.

Sud Italia, 72 Aubert Park - Decision Adjourned

The Sub-Committee adjourned the decision regarding the new premises licence for Sud Italia, 72 Aubert Park. The Licensing Officer informed the Sub-Committee that the applicant had to deal with an emergency at the premises and was unable to attend the meeting.

Councillor Clare Jeapes noted that the applicant had failed to inform the authority that they were not going to attend the hearing until a few hours before it commenced. The Sub-Committee decided that they did not have sufficient details about the emergency to determine whether it would be correct to continue in the absence of the applicant.

The Sub-Committee agreed to adjourn the hearing and informed all parties that they would be advised of a new date.
