Summary
Here is a summary of the scheduled discussions for the Licensing Sub-Committee meeting. The meeting was convened to consider two temporary event notices (TENs) for Star Market, a convenience store located at 5-9 New Street, Boston, following objections from the Chief Officer of Lincolnshire Police. The notices were submitted to allow the sale of alcohol for consumption off the premises. Councillor Stuart Evans, Councillor Paul Gleeson, and Councillor Lina Savickiene were scheduled to be in attendance.
Star Market, 5-9 New Street, Boston
The sub-committee was scheduled to discuss two temporary event notices submitted by Se & Se Consultancy Ltd on behalf of Demirci Ridvan for Star Market. The notices requested permission to sell alcohol for consumption off the premises between 08:00 and 23:00 daily during the periods of 18 July to 24 July 2025, and 28 July to 3 August 2025.
The report pack included a location plan for the premises, which is situated in a predominantly commercial area of Boston town centre.
The report pack also noted that the premises is located within an area covered by a Public Space Protection Order (PSPO). PSPOs are designed to prevent behaviour that has a detrimental effect on the quality of life of those in the community, is persistent or continuing, and is unreasonable, by imposing restrictions on the use of an area. In this case, the PSPO restricts the consumption of alcohol in the designated area.
The Chief Officer of Lincolnshire Police submitted objections to both TENs, stating that allowing the premises to operate in accordance with the notices would undermine all four licensing objectives1. The objection notices stated that the applicant had not demonstrated how the licensing objectives would be promoted, given the location of the premises within the PSPO area, and that there was no provision to impose suitable conditions relating to alcohol sales.
The basis behind the objection being that with no provision to impose suitable conditions relating to alcohol sales within the PSPO area, the applicant cannot demonstrate that the objectives will be promoted.
The objection notices also raised concerns that Lincolnshire Police had had no prior dialogue with the notice giver, and that the TENs had been submitted without ample time to research the notice giver and fully understand the nature of the business.
The report prepared by Anna McDowell, Senior Licensing Officer, summarised the options available to the sub-committee. These included:
- Taking no action and permitting the activities as described in the notices, if the sub-committee was satisfied that the licensing objectives would be promoted.
- Issuing a counter notice preventing the events from going ahead, if the sub-committee was satisfied that the licensing objectives would be undermined.
The report noted that the sub-committee could not modify the notices in any way, nor could it impose conditions on the notices, as there was no premises licence in force for Star Market.
The report pack included extracts from the Section 182 Guidance made under the Licensing Act 20032, and the council's Statement of Licensing Policy Extracts. The sub-committee was asked to consider these documents when making its determination.
The report also reminded the sub-committee of its duty under section 17 of the Crime and Disorder Act 1998 to do all it reasonably could to prevent crime and disorder in its area.
